Albay votes for SMC takeover of electric co-op

Power consumers in Albay province voted to allow the privatization of debt-ridden Albay Electric Cooperative to ensure the delivery of uninterrupted electricity in the province.
Unofficial results of a referendum held by the National Electrification Administration Saturday showed that most power consumers in the province were open to the entry of a private sector in Aleco, instead of having another electric cooperative take over the operation.

San Miguel Corp. was the lone private sector bidder in the takeover of the management of the electric cooperative.
Energy Department director Mylene Capongco confirmed the results of the referendum, but said it remained “unofficial.”
Another source privy to the referendum said the results showed “PSP [private sector participation] is ahead of cooperative to cooperative by 2,015 votes.”
Another source said following the results of the referendum, the interim board of Aleco would now issue the notice of award to San Miguel subsidiary SMC Global Power Holdings Corp.
“The next step now is the confirmation of award to SMC, then signing of the concession agreement, then assumption in the management of Aleco,” the source said.
The interim board of Aleco earlier approved the bid offer of San Miguel.
Energy Secretary Carlos Jericho Petilla earlier said it was the only bidder interested in taking over the operations of Aleco after the others withdrew.

“There is one bidder and that’s San Miguel. Aleco conducted the bidding and is currently evaluating the bid [of San Miguel]. I believe so, [they are the winning bidder]. San Miguel is already the winning bidder given the absence of other bidders,” Petilla said.
Petilla said under the terms of reference, San Miguel would just manage Aleco, and not have ownership over the electric cooperative of Albay.

Comelec to hold plebiscite for creation of Davao Occidental

THE Commission on Elections (Comelec) will hold a plebiscite for the creation of the new province of Davao Occidental, simultaneous with Barangay and Sangguniang Kabataan (SK) elections on October 28.
According Commissioner Christian Robert Lim, holding the plebiscite together with the village and youth polls will save the poll body some P29 million since they will only spend more than P11 million. At least P40 million is needed to hold a separate plebiscite.
On July 23, 2013, Congress enacted Republic Act (RA) 10360 or an "Act Creating the Province of Davao Occidental."
A total of 523,862 registered voters (as of the May 13, midterm polls) of Davao del Sur, excluding Davao City, will participate in the plebiscite that will determine whether the new province will be created or not.
The proposed province will be composed of the municipalities of Sta. Maria, Malita, Don Marcelino, Jose Abad Santos and Sarangan. The five municipalities were carved out from the eight municipalities in the second legislative district of Davao del Sur.
Lim said the voters in the said province will be using a longer ballot since it would include voting for the creation of Davao Occidental. Voters will be asked to answer the question by yes or no.
In RA 10360, the poll body is mandated to supervise the conduct of a plebiscite for the approval of the creation of Davao Occidental by the majority of the votes cast by voters in the affected areas, within 60 days after the law becomes effective.
However, the Comelec on November 27, 2012, suspended the conduct of all plebiscite as a matter of policy in view of the preparations for the May 13, 2013 National and Local Elections. The policy of deferment was later extended on July 9, 2013.
On July 31, 2013, the poll body approved the holding of the plebiscite.

Palawan land owner asks Noy gov’t to pay P81M for PAF HQ rental

President Aquino and his men had been ignoring a plea of a private land-owner for payment of a long standing obligation amounting to P81 million, whose 3.2 hectares land had been usurped by the military using as Philippine Air Force (PAF) headquarters in Puerto Princesa City, Palawan, without any payment, since 1973, that the Budget department considered always as “least priority.”
Alexander Pio Lacandazo, 65, of Rengel Road, Puerto Princesa City, Palawan, said he had sent his letter addressed to Aquino, Defense Secretary Voltaire Gazmin and Budget Secretary Butch Abad asking for the payment of P81 million in his property which has been used as Air Force headquarters, the Antonio Bautista Air Base (ABAB) in Puerto Princesa City.
“I want them to know that the headquarters of the PAF in Puerto Princesa City is squatter in my property. They never paid a single centavo ever since,” Lacandazo said.
In his two-page letter to Aquino, which was received in Malacañang under bar code RC1217O71, “I am highly requesting your good governance in your capacity as President of the Republic of the Philippines, to effect the payment of my property acquired for four decades. I am demanding your good self to issue a directive to the Department of National Defense, and to the occupying 570th Composite Tactical Wing of Philippine Air Force in Puerto Princesa City, Palawan. I am requesting sir, asking your favorable action for my claim because my purpose is to receive the payment as private property owner,” Lacandazo said.
The 570th Composite Tactical Wing of the PAF is now known as the ABAB in Puerto Princesa City, adjacent to the location of the Puerto Princesa International Airport.  
Lacandazo said the 3.2-hectare property was occupied by the Armed Forces of the Philippines (AFP)-PAF for almost four decades when former President Ferdinand Marcos declared martial law and issued his Letter of Instruction (LoI) No. 260 that empowered the AFP in Palawan to usurped the property for military use.
Lacandazo said that on March 15 and 22, 2007 meetings with AFP Real Estate Office at Camp Aguinaldo, he was advised that his claim be held in abeyance until such time that he could establish conclusive evidence of ownership of the property as the documents were still under the name of his late father Pedro Pio.
“With this requirement, I have already complied and submitted all necessary documents pertaining to the claim. Likewise, the property was already transferred in my name as evidence by the attached TCT No. 179590,” Lacandazo said.
He added that despite coordination with the PAF for the budget allocation since 2006, the proposed budget was never considered because there was no budget for the capital outlay for 2009 until 2012.
“As I have reiterated in my request to expedite release of funds and despite hard efforts to get necessary funding from Department of Budget and Management, the matter was not considered by the AFP for several years now,” he said.
At present, the value of the property, based on the assessment of the City Assessor’s Office of Puerto Princesa City is now P2,500 per square meter.
“In view of this, I am constrained to revise my claim to conform to the value based on the certification from the City Assessor’s Office and Resolution of the Appraisal Committee of Puerto Princesa City which cost P81,165,000 as computed,” Lacandazo said.

Two former deputy commissioners of the Bureau of Customs and a congressman from Mindoro are allegedly jockeying to replace beleaguered Customs Commissioner Rufino Biazon who has come under fire for rampant smuggling and the agency’s repeated failure to meet collection targets.
The Customs official, who asked not to be identified for fear he might be suspected of being interested in a higher position, identified the former Customs officials are deputy commissioner Horacio Suansing and deputy commissioner Peter Manzano.
Aside from the two deputy commissioners, the source said Mindoro Oriental Rep. Reynaldo Umali, who was also a deputy commissioner before he entered politics, is also supposedly interested in replacing Biazon.
Umali was one of the House prosecutors in the impeachment trial of ousted Supreme Court Justice Renato Corona while Suansing is a nephew of Senator Miriam Defensor Santiago. Manzano, on the other hand, is associated with Executive Secretary Paquito Ochoa.
“The people close to Deputy Commissioner Manzano are now looking for more allies in Malacanang for him to be appointed and take over the post, while supporters of Dep. Com. Suansing are seeking recommendation from Liberal Party officials, especially its president (Local Government Secretary) Mar Roxas,” the source said.
On Friday, ABS-CBN News reported that Biazon named former deputy commissioner Gallant Soriano as being behind the demolition job against him, but Soriano denied seeking Biazon’s ouster.
The source made the revelation shortly after Malacañang spokeswoman Abigail Valte said in an interview with a government radio station that the Palace is indeed considering an option to privatize the Bureau of Customs, but the matter was still in the initial stages of discussion.
“From what I understand from [the] commissioner, that is one of the suggestions [but] the discussions are initial,” Valte said on dzRB radio.
Valte’s made the remark three days after President Aquino himself said on Wednesday that the administration is planning to implement an unspecified plan to purge of the bureau of corrupt officials.
The Chief Execurtive did not specify plans but he said Biazon was aware of the plans and the Palace was only considering the timing of the action.
“Just wait for the long-planned solution so that we can ensure that all Customs officials are not corrupt,” Aquino said during the groundbreaking of the Roxas Airport Development Project in Roxas City in Capiz on Wednesday.
Last month, Biazon himself told members of the Makati Business Club, Management Association of the Philippines and the European Chamber of Commerce of the Philippines that the administration was crafting plans to abolish the BoC as a government agency and privatize it.
The idea to privatize the Customs burea, as well as the Bureau of Internal Revenue, was first suggested by the World Bank and International Monetary Fund when the Philippines was beginning its exit program from the IMF during the administration of former President Joseph Estrada.

Mishandling the Sabah issue

There appears to be a consensus among analysts and observers of the Sabah dispute after followers of Sulu Sultan Jamalul Kiram III occupied a village called Lahad Datu in Sabah and after some have died in firefight.  The Aquino administration indeed committed a series of blunders.
Let’s rewind a bit. The sultan felt snubbed in the signing of the Bangsamoro Framework Agreement, which the administration touted as the key to achieving peace in Mindanao.  In fact the Sultan claimed he had sent not one but three letters to Malacañang where he expressed his desire to be consulted on the peace issue. President Aquino said the letters must have been lost in the bureaucratic maze.
What a lame excuse. Executive Secretary Paquito Ochoa serves as some kind of a Grand Central Station where all letters to the President pass through. Palace insiders however say that Ochoa indeed received the letters but he passed them through Presidential Adviser on the Peace Process Teresita Deles.  I cannot confirm this, but I am told that Deles decided not to let the President know about it.  She kept the letter, believing it would have no impact on the peace process.
Mr. Aquino reportedly berated Deles when he learned about what happened.  A bureaucrat with delicadeza would have resigned – Deles obviously does not have it.
Thus the Sultan, perhaps thinking that it occupying a village in Sabah is the only way for the government to acknowledge its rights, decided to send 200 of his followers to the disputed territory. There are 800,000 Filipino Muslims who have, legally or otherwise, made Sabah their home.
Instead of being sensitive to the Sultan’s claim and to the plight of Filipinos in Sabah who were being threatened by Malaysian police, President Aquino went on television, flanked by Justice Secretary Leila de Lima and Interior and Local Government Secretary Mar Roxas, warning Kiram that he and his men could face charges for constitutional violations. He told them to come home.
But the Sultan says Sabah is home.
Don’t threaten Tausogs with arrest or criminal charges.  They are very proud, like Maguindanaoans and Maranaws.
The stance taken by Malacañang made it look like it was siding with Malaysia.
Who are advising President Aquino? It looks like he was not aware of the implications of events. Analysts say the issue is not just legal.
What is the bottom line of the dispute? Historic and documentary evidence of ownership by the Sulu Sultanate over Sabah is clear and unmistakable. This is why Malaysia refuses to bring the matter to the International Court of Justice, or the United Nations.
In 1704, the Sultan of Brunei sought support from the Sultan of Sulu to quell a rebellion in Brunei. In gratitude, the Sultan of Brunei gave North Borneo, as Sabah was called then, to the Sultan of Sulu. In 1874 or 174 years later, Baron Von de Overbeck leased North Borneo from the Sultan of  Sulu for 5,300 Mexican pieces of gold a year. Overbeck created the British North Borneo Co., a chartered company by Great Britain. After the death of Sultan Jamalul Kiram in 1936, the British company stopped the leased payments, but a Session Court in North Borneo ordered resumption of payment.
When North Borneo was renamed Sabah, despite objections of the Philippine government, Sabah became part of the Federation of Malaysia.
When the Federation of Malaysia was created in 1963, Malaysia converted the stipulated rental payment into Malaysian ringgit (now equivalent to P77,000) but not the equivalent of 5,300 pieces of Mexican gold. And this is where the core of the dispute lies. The lease agreement used the word “padjak.” After 85 years of paying rent to the Sultanate of Sulu since 1878, Malaysia in 1963 conveniently misinterpreted the word “padjak” to mean cession or sale. The Sulu Sultanate insists “padjak” means rent, and that it is not a sale.  And why does Malaysia continue to pay rent to the Sulu Sultanate? Malaysia’s position is untenable.
As a lawyer, I  know that a sale needs a specific price. Thus, the continuous indefinite annual payment of P77,000 by Malaysia to the Sultanate cannot by any stretch of the imagination be a definite sale by any legal definition.
This leads me to ask: Didn’t the legal advisers of President Aquino ever consider the legal implications of the Sabah claims? Obviously not since that would rock the boat in our political and economic relations with Malaysia, especially now that Malaysia is brokering the Bangsamoro Framework Agreement.
What is clear is that President Aquino deemed our relations with Malaysia more important than the Sultanate of Sulu.
The President threatened to arrest and charge Kiram and his followers. That does not make sense. Why didn’t Malacañang organize a special task force to attend to the dispute? Who appears anti-Filipino now?
I have been told that even Christians in Mindanao are sympathizing with the Sultanate of Sulu.
“Honor is above life,” the Sultan said. I hope I am wrong on this, but I fear this will have a negative impact on the peace process in Mindanao and our relations with Malaysia.
