NO INCREASE

No pay hike for state workers but more taxes yes

President Aquino promised to listen to his boss—the Filipino people. And yet his administration is turning out to be most insensitive.

There will be no pay hike for government employees this year and the next, not until 2016 if ever the Department of Budget and Management completes its assessment of the compensation classification system (CCS) of government employees, which it doesn’t seem in a hurry to do so.

And yet the Bureau of Internal Revenue (BIR) is imposing new taxes on government employees’ financial benefits and allowances.

Talk about a double whammy.

These allowances and other benefits, which include honoraria, food subsidy, hospitalization and medical benefits, clothing, cost-of-living and transportation allowances, and monetized value of leave credits were never taxed before.

But Revenue Memorandum Order (RMO) 23-2014 that the BIR issued in June and started implementing last month imposed a 30% to 32% tax on these benefits.

Again, so insensitive.

The benefits that government employees receive are supposed to support their families’ everyday needs, precisely because their compensation is not enough. Most of them are buried in debt, borrowing in advance their monthly salaries or relying on credit cards to make it until their next payday.

 Most government workers are not high officials with top salaries and perks, who get paid in thousands just for attending the board meetings of their government corporations, or are driven around in gas-free vehicles.

Most government workers’ salaries are eaten up by their household bills, their pay hardly enough to cover the skyrocketing prices of basic commodities, oil, gasoline, electricity and water bills.

Government workers really need these fringe benefits to survive. Why charge them such a substantial amount in taxes?

Why not go after the smugglers? From 2002 to 2011, the government lost more than P1.33 trillion in revenue due to smuggling, according to the Federation of Philippine Industries.

By imposing additional burdens on the already overburdened state workers you are taking away their incentive to deliver efficient service to the general public.

How can you work properly or focus your attention on the needs of the citizen in front of you if you are worried about where to get your child’s tuition or how to pay your overdue electricity bill?

Indeed, the BIR’s oppressive deductions on their benefits in the absence of salary increases tempts state workers to commit graft and corruption just to make ends meet.

Former Senate President Aquilino Pimentel Jr. led the government employees in filing the petition before the Supreme Court assailing the BIR’s new memorandum imposing hefty taxes on their benefits and bonuses.

We thank him for taking up the cudgels for our state workers. We in the Trade Union Congress of the Philippines fully support this fight.

RMO 23-2014 of the BIR must be nullified. According to the petitioner/government employees, it is unconstitutional as it usurps the power and authority of the legislature in defining new offenses and prescribing penalties, particularly on local government units.

“The duties imposed on the local government officials mentioned in the paragraphs immediately preceding thrash the principles of decentralization and local autonomy set forth in the Local Government Code of 1991, Republic Act 7160,” the petitioner said.

The petitioner said the BIR also violated Section 2 of the National Internal Revenue Code when it implemented the RMO without necessary approval of the secretary of finance.

Tax measures should be just, fair and executed equitably but here they are oppressive and unfair; and this particular one really calls for second thought and appropriate action.

I already said this in a previous column but I will never get tired of saying it: Workers are already overburdened by taxes in this country.

The Philippines has the third highest individual income tax rate in the Association of Southeast Asian Nations (Asean), after Thailand (37%) and Vietnam (35%).

Then there is the value added tax, which at 12 percent here is higher than Malaysia’s 10 percent, Singapore’s 7 percent, Thailand’s 7 percent, Australia’s 10 percent and Japan’s 5 percent.

The VAT causes prices to increase, reducing the worker’s ability to purchase goods and services. Worker’s wages further decline because their purchasing power declines.

Now the government is even deducting a third of the benefits of poorly paid state workers.

Again, we would not complain if we are getting our taxes’ worth but every day we experience absurdities that illustrate the contrary, like flooded, traffic-choked and crime-infested streets, poor public services, and sickening corruption from the lowest to the highest ranks in government.

Yolanda victims set deadline for Aquino to heed their plea

The Alliance of Typhoon Yolanda Victims (ABBAT) set a deadline on the Aquino administration to grant their petition for 40,000 cash relief and abolition of the ‘no-build zone’ policy on or before February 14.
ABBAT community leader Patrick Escalona rejected rehab czar Panfilo  Lacson’s option to provide construction materials instead in lieu of the 40,000 cash relief originally meant for daily subsistence of every family. He said the amount is too small to replace the rehabilitation program of the government.
 Sister Edita Eslopor  vowed that they will stage a series of protest rallies until the government heeds their call.
“The massive number of people is proof of their intense discontent over Mr. Aquino’s criminal negligence and utter incompetence in looking after the welfare of the people. This is just the first of a series of protests that will fill the streets of major cities across the country to express our indignation at the Aquino administration,” Eslopor said.
Exactly a week  ago when more than  10 thousand Yolanda survivors from Leyte and Samar staged a protest march in the streets of this city  to express their indignation against the inaction of the national government  on the plight  of the victims of the super typhoon, Malacanang  has yet to act on their demands.
Yolanda survivors under the banner of People Surge laid out specific demands  such as provision and sustenance of food aid, until necessary, to aid full recovery  while source of livelihood  does not stabilize and an immediate provision of P40,000 cash relief for every family   devastated by Yolanda,  during the rally  considered as one of the biggest protest action in the country directed against the Aquino  administration.
According to Dr. Efleda Bautista, a storm survivor herself and current executive vice chairperson of People Surge, instead of directly addressing the problems presented by the Yolanda victims, Presidential spokesperson Edwin Lacierda belittled the series of protests as mere “concerted effort of a few to convince the public that most of our countrymen are dissatisfied with the way the national government  respond to the catastrophe.”
“He  (Lacierda) believes in the very good rating of the president. He is convinced that Yolanda survivors are happy towards P-Noy’s rehab efforts.” Bautista said.
Bautista lambasted  Lacierda’s statement    saying, “The Aquino administration is pathetic for being a die-hard defender of a bogus survey even after survivors from Eastern Visayas—the worst hit region by the typhoon—have spoken of their real condition.”
“With no sense of urgency to respond to ‘Yolanda’ survivors’ demands, this government is victimizing us [‘Yolanda’ victims] all over again,” Bautista lamented.
Eslopor, a Benedictine nun and Chairperson of People Surge, insisted that the Aquino government must have consulted the victims at the onset of any rehab effort.
She said that at the rate by which government implements policies like the ‘no-build zone’, not going through any real consultation among major stakeholders who are the victims, Aquino’s rehab plan is going somewhere else, certainly not towards genuine recovery of typhoon victims.
In another development, two opposition lawmakers on Saturday renewed their appeal for action from the Aquino administration on the plight of the survivors of typhoon Yolanda, saying that the urging from the Catholic Church would also be a ‘voice from Heaven’ that must be heeded.
Gabriela party-list Rep. Luz Ilagan of the Makabayan Bloc and Abakada party-list Jonathan dela Cruz, member of the Independent Minority Bloc in the House of Representatives headed by Leyte Rep. Ferdinand Martin Romualdez, said that the   administration has all the resources needed by the victims, and that every needed assistance for them is possible if only it has the political will to do such .
“Definitely, it’s the Voice of God urging those in power to heed the crisis of a people who suffered from such devastation who continue to suffer from the vagaries of politics,” Dela Cruz told the Manila Standard.
His statement came after Catholic Bishops Conference of the Philippines president Lingayen-Dagupan Archbishop Socrates Villegas appealed to the government as well as  donor-groups to listen to the Yolanda victims and not just provide them with relief or shelter without considering their needs.
Ilagan lamented that the victims are still waiting for government action on them.
Ilagan said that the urging of Villegas is “not only the ‘voice of God’ but also the voice of common sense and good governance.”
She criticized the Aquino government for lacking a comprehensive plan for the victims and survivors of natural calamities.
“Victims cannot rely on relief forever. After relief is the rehabilitation phase to allow the people to return to normalcy as early as possible.  Government’s action or the lack of it gauged by the speed and effectiveness of transition from relief to rehabilitation to rebuild—Obviously, the Aquino administration is short on this,” Ilagan said as she recalled the government’s inaction on the victims of super typhoon Pablo in December 2012 as well as of Zamboanga siege in September 2013. Workers protest PNoy’s new labor laws

BAGUIO CITY — Anakpawis Cordillera Regional Coordinator Micheal Cabangon said that the signing of President Benigno Aquino III of two new labor laws will not benefit the Filipino workers and their families at all.
On March 22, the president signed into law the Act Strengthening Tripartism. The law declared tripartism in labor relations as a state policy where employers and workers will be part of policy-making bodies of the government. The said law mandates the establishment of a National tripartite Industrial Peace Council (NTIPC). The body will be headed by the secretary of the Department of Labor and Employment (DOLE).
Cabangon said such NTIPC will only serve as a venue to facilitate the collaboration among big businessmen, pro-management labor unions and groups and the government setting aside the true plight of the workers in the country. He said worker’s experiences in the past are enough to define how the workers are being waylaid when it comes to policy-making decisions and how the government favors the big businesses over the lowly workers such on the demand of wage increase.
In a statement of Kilusang Mayo Uno (KMU) national office, the labor center condemned the president for signing the two new labor laws.
KMU added that Filipino workers do not welcome Aquino’s “Trojan Horse” this coming Labor Day 2013.
According to KMU, the compulsory arbitration being mandated by the creation of NTIPC will hinder the worker’s right to strike. The group said it will add up to the already numerous requirements for holding strikes against unfair labor practices and abusive employers.
KMU national Chairperson Elmer Labog said the government tries to package said laws as pro-labor but they actually signal the intensification of violations of worker’s democratic rights.“These laws show that Aquino continues to serve big capitalists by offering cheap and repressed labor. He is trying to tighten control over workers in order to ensure big capitalists’ profits amidst crisis conditions,” Labog added. He said that the government is making existing labor laws worse for the country’s workers.
According to Labog, they have seen tripartism and compulsary arbitration in action and they are not pleased with their results. He said tripartism has only resulted in the crafting of more and worse anti-labor policies while compulsary arbitration has been used to delay workers’ strike so that big businessmen can act to lessen the impact of the workers’ protests.
KMU stated that the laws compliment the government’s refusal to hike wages by a significant amount, implementation of wage cut and wage freeze through the Two-Tiered Wage System, and legalization of contractual employment through the Labor Department’s Order No. 18-A Series of 2011. The labor center added that the new laws jibe with the Labor Secretary’s power to assume jurisdiction over labor disputes, legalized by Republic Act 6715 or the Herrera Law, an amendment to the country’s Labor Code.
Last April 12, KMU led a workers protest action at Mendiola in Manila to express their condemnation on the signing of the two new labor laws.

MWSS chairman denies allegations

MANILA, Philippines - Employees of the Metropolitan Waterworks and Sewerage System (MWSS) on Monday held a protest rally to denounce what they call are "excessive" benefits given to members of its board.
Holding placards and streamers, around 30 MWSS employees protested during their lunch break. They claimed that each board member is paid P9,000 per regular committee meeting and P 15,000 for board meeting.
Nap Quiñones, MWSS Labor Association president, claimed MWSS officials and consultants are violating the new government-owned and controlled corporation (GOCC) law.
The group said MWSS trustees would schedule 4 committee meetings in a day, which would total earnings of P36,000 a day.
The group also accused the new MWSS management of hiring 36 consultants at P30,000 each.
They noted while the board members slashed their meal allowance of P150 a day to P3 a day, they feasted on excessive allowances.
The protesters were joined outside the MWSS by consumer group Water for All Refund Movement (WARM) who also denounced the hefty allowances and demanded the ouster of MWSS officials.
WARM also insisted on the refund of around P2 billion in collections to fund the cancelled Laiban dam and Bulacan irrigation projects initiated by the MWSS during the previous administration.
'Baseless accusations'
MWSS chairman Ramon Alikpala said all the accusations of the group were not true and have no basis. While Alikpala did not dispute the P9,000 per diem for each committee meeting, he insisted that the board members do not receive compensation or salary package.
He said this amount is within bounds of the law. Alikpala said it is not true that members of the board had meetings held 4 times a day.
There was an instance in April that several committee meetings were held but Alikpala said these were attended by different members of the board.
Compared to the previous chairman of the board who received P5 million a year, Alikpala said he only gets an income of P500,000, just a fraction of what his predecessor got.
Alikpala admitted the reduction of the meal allowance but stressed the additional compensation has no basis in law. He also defended the hiring of consultants which he claimed are needed in specialized area concerns of the MWSS but the number did not reach 36 at all.
When asked if he will resign, Alikpala said "if I do leave MWSS, it won't be because of this."
Meanwhile, Alikpala said the collected amount for the shelved Laiban and Bulacan irrigation project will not be refunded since the government will push through with these projects anyway. Any over- or undercollection can be remedied in the current rate rebasing done by the MWSS regulatory office for both Maynilad and Manila Water, he added.
