No pay hike for state workers but more taxes yes

President Aquino promised to listen to his boss—the Filipino people. And yet his administration is turning out to be most insensitive.

There will be no pay hike for government employees this year and the next, not until 2016 if ever the Department of Budget and Management completes its assessment of the compensation classification system (CCS) of government employees, which it doesn’t seem in a hurry to do so.

And yet the Bureau of Internal Revenue (BIR) is imposing new taxes on government employees’ financial benefits and allowances.

Talk about a double whammy.

These allowances and other benefits, which include honoraria, food subsidy, hospitalization and medical benefits, clothing, cost-of-living and transportation allowances, and monetized value of leave credits were never taxed before.

But Revenue Memorandum Order (RMO) 23-2014 that the BIR issued in June and started implementing last month imposed a 30% to 32% tax on these benefits.

Again, so insensitive.

The benefits that government employees receive are supposed to support their families’ everyday needs, precisely because their compensation is not enough. Most of them are buried in debt, borrowing in advance their monthly salaries or relying on credit cards to make it until their next payday.

 Most government workers are not high officials with top salaries and perks, who get paid in thousands just for attending the board meetings of their government corporations, or are driven around in gas-free vehicles.

Most government workers’ salaries are eaten up by their household bills, their pay hardly enough to cover the skyrocketing prices of basic commodities, oil, gasoline, electricity and water bills.

Government workers really need these fringe benefits to survive. Why charge them such a substantial amount in taxes?

Why not go after the smugglers? From 2002 to 2011, the government lost more than P1.33 trillion in revenue due to smuggling, according to the Federation of Philippine Industries.

By imposing additional burdens on the already overburdened state workers you are taking away their incentive to deliver efficient service to the general public.

How can you work properly or focus your attention on the needs of the citizen in front of you if you are worried about where to get your child’s tuition or how to pay your overdue electricity bill?

Indeed, the BIR’s oppressive deductions on their benefits in the absence of salary increases tempts state workers to commit graft and corruption just to make ends meet.

Former Senate President Aquilino Pimentel Jr. led the government employees in filing the petition before the Supreme Court assailing the BIR’s new memorandum imposing hefty taxes on their benefits and bonuses.

We thank him for taking up the cudgels for our state workers. We in the Trade Union Congress of the Philippines fully support this fight.

RMO 23-2014 of the BIR must be nullified. According to the petitioner/government employees, it is unconstitutional as it usurps the power and authority of the legislature in defining new offenses and prescribing penalties, particularly on local government units.

“The duties imposed on the local government officials mentioned in the paragraphs immediately preceding thrash the principles of decentralization and local autonomy set forth in the Local Government Code of 1991, Republic Act 7160,” the petitioner said.

The petitioner said the BIR also violated Section 2 of the National Internal Revenue Code when it implemented the RMO without necessary approval of the secretary of finance.

Tax measures should be just, fair and executed equitably but here they are oppressive and unfair; and this particular one really calls for second thought and appropriate action.

I already said this in a previous column but I will never get tired of saying it: Workers are already overburdened by taxes in this country.

The Philippines has the third highest individual income tax rate in the Association of Southeast Asian Nations (Asean), after Thailand (37%) and Vietnam (35%).

Then there is the value added tax, which at 12 percent here is higher than Malaysia’s 10 percent, Singapore’s 7 percent, Thailand’s 7 percent, Australia’s 10 percent and Japan’s 5 percent.

The VAT causes prices to increase, reducing the worker’s ability to purchase goods and services. Worker’s wages further decline because their purchasing power declines.

Now the government is even deducting a third of the benefits of poorly paid state workers.

Again, we would not complain if we are getting our taxes’ worth but every day we experience absurdities that illustrate the contrary, like flooded, traffic-choked and crime-infested streets, poor public services, and sickening corruption from the lowest to the highest ranks in government.

RECOMMENDATIONS

What the new President of the Philippines must do:

1.   Cheapen the electricity – Open the Bataan Nuclear Power Plant. Prohibit “Oligarchs and Big Corporate People” from owning/operating the Plant. Instead, create a law that would make the BNPP a public company, then put EVERY FILIPINO CITIZEN as STOCKHOLDER of the BNPP Corporation. All Citizens must be given an account number and passbook at a government bank and all profits being incurred by the BNPP from servicing CORPORATIONS, MALLS AND INDUSTRIAL CENTERS, owned by OLIGARCHS shall inure to the benefit of all the common man. Wala pong BLUE-CHIP-BLUE CHIP dito. Make the profits available for everybody. Why not? Sila na lang ba ang pwede kumita???

2.   ABOLISH Contractualization of Labor, especially-  ng SM- Sobrang abuso na ang SM Corporation. Obligate them to regularize at least 75% of all their contractuals after 6 months. What the SM is doing right now is abuse of human dignity and labor. STOP CONTRACTUALIZATION.

3.   ASSIST people, farmers, laborers, fishermen, planters, skilled personnel or even professional groups establish profit-based cooperatives like agri-business cooperatives, rural banking or even mining cooperatives. Instead of just waiting for the submission of complete paperwork from the common tao, the GOVERNMENT must PRO ACTIVELY ASSIST the people earn money!!! Huwag itago sa common TAO ang mga paraan kung papaano kumita ng pera. Kulang ang ginagawa ng TRC at TESDA. Dapat hanggang grassroots ang efforts nila. With all the MONEY IN THE GOVERNMENT, it is too impossible for the government not to generate employment and economic opportunities.

4.   PROMOTE ALL FILIPINO PRODUCTS. Huwag patayin ang sariling atin. Mandate TV and Radio Advertising to at least 60% of the products advertised are purely FILIPINO-made. Nagiging dumping ground na tayo ng mga foreign products kaya ang dami na sa atin ang nagkakasakit ng cancer, skin diseases, viruses or even high blood. We should help local and small time capitalists.

5.   Reforestation -  the government should embark on massive reforestation, PRONTO!!! Nauubos na mga puno natin sa logging. Sa Quezon nalang, halos ubos na mga century trees. Inubos na ng mga Angara.

6.   Promote Food Security – assist and help the farmers, fishermen, fruit growers, livestock keepers and contract farming industry. STOP BUILDING MALLS AND GROCERIES!!! Let us patronize our public markets and our agricultural industry.

7.   Promote the HERBAL medicine industry. This is cheap, healthy and readily available. Because if people are encouraged to be proactive in the health keeping, they will spend less and less on modern medicine. They will become more dependent on themselves and less dependent on Doctors. Health is a personal responsibility.

8.    Open the communications industry to foreign investors. Sobra na ang SMART at GLOBE. Imagine, 1 Peso per text??? Grabe, greedy talaga! And not to mention, they’re intrusion into your private number by way of ADS and announcements. They are using your number to promote their businesses. They’re killing the hen that lays the golden egg. Or increase the police powers of the NTC to regulate the cost of calls and texts.

9.   COMPEL THE BIR to collect IMMEDIATELY from TAX EVADERS like LUCIO TAN etc!!! We need the MONEY TO JUMPSTART THE ECONOMY. And we need it NOW!!!

10.                     Deregulate the price of Oil. Bring back the OPSF.

11.                     Reduce the prices of basic commodities. Ano pa nga ba?

12.                     Reduce TAXES. You are reducing the Filipino people and especially the middle class to SLAVERY. Abolish unnecessary taxes or fees like the Homeowner tax. We are virtually left with NOTHING!!! Wala na kaming pera ibabayad!!!

13.                     Build more public hospitals. This country needs it. Maraming mahirap at maraming naghihirap. We should not deny our impoverished brothers the needed healthcare. GAGO na ang susunod na PRESIDENTE kung mga CASIQUE pa rin ang tutulungan niya!

14.                     Reform the SSS, Philhealth and GSIS. Reduce contributions, reduce overexposure of investments and increase benefits of the common tao!!!

15.                     Remove the name NINOY AQUINO INTERNATIONAL AIRPORT (NAIA), revert back to MIAA. Noynoy’s family don’t own our airports.

16.                     Penalize the Filipino movie industry. PURO RACKET, LOVE TEAM AT DRAMA ang ipinapakita, WALANG VALUES NA ITINUTURO SA MGA BATA! Si Cesar Montano, Peque Gallaga at Raymond Red lang ang MAGALING. karamihan, GAGO!

23.                     Reform our Educational processes. Masyadong foreign ang approach. Besides, we buy too many books na di naman kailangan ng bata.

24.                     Encourage the values of RESPECT and RESPONSIBILITY in our Communities.

25.                     Cultivate the Deuterium and Natural Gas for the benefit of the common tao. They should be the stockholders and not the Ayalas, Cojuangcos, Sys, Yuchengcos, Del Rosarios etc.

26.                     Reduce TV commercials during certain periods at evenings.

Luisita terror tactics blasted

Angeles City — A farmers’ group  belonging to Alyansa ng mga Magbubukid sa Gitnang Luzon on Saturday condemned the alleged assault by the Tarlac Development Corporation against the Alyansa ng Manggagawang Bukid sa Asyenda Luisita.
The AMGL  in a statement said that   when the Department of Agrarian Reform  began the raffle-distribution of certificate of land ownership awards since October, Tadeco and another corporation, Luisita Realty Corp built fences around the 100-hectare land in Barangay Cutcut and about 400 hectares in Barangay Balete and recently last October 31.  AMBALA’s Dennis Dela Cruz who actively worked at a ‘Bungkalan’ (cultivation) site was murdered in Balete.

 Joseph Canlas, AMGL chairperson said, “Hacienda Luisita is under a reign of terror, perpetrated by the hacienda ownes led by the family of President Benigno Aquino III .  “They have sabotaged the Supreme Court decision to distribute the lands by using the anti-farm workers’ schemes implemented by DAR, and now an AMBALA leader was mercilessly killed,” Canlas said.
The AMBALA, a farm workers’ alliance and AMGL chapter in Luisita expressed belief that the murder of Dela Cruz is connected to the land issue as he was a staunch activist working with the ‘Bungkalan’ campaign, and was threatened by TADECO security guards last September.
The group in a statement said that it was to terrorize the farm workers who are fighting for their right to own land.

 The AMBALA   earlier reported that military deployment in Hacienda Luisita had intensified as at least four military tanks were sighted to have entered the estate.
“The Aquino government deployed many elements of the police and military during the so-called CLOA  distribution by DAR, to subvert the protest of the farm workers.  Now they are actually sending in more forces to intimidate the unarmed farm workers,” Canlas said.

 `The AMGL stated that the Cojuangco-Aquino family is firm in keeping control over Hacienda Luisita as it would bring them billions of profit.  Agricultural land valuation around the Subic-Clark-Tarlac Expressway (SCTEx) and Tarlac-Pangasinan-La Union Expressway (TPLEx) ranges from P1 million to P6 million per hectare or P100 per square meter to P600 per square meter, thus, the the Hacienda land was reclassified as the Cojuangco-Aquino family prepared in the land use plan furnished by the Luisita Realty Corp. in 1998.
Canlas, also a fourth nominee of the Party List AnakPawis charged that, “the Cojuangco-Aquinos are notorious in attacking the farm workers. The estate was under martial law during the Marcos dictatorship, de-facto martial law before and after the Hacienda Luisita massacre in 2009, the Oplan Bantay Laya is in full effect.”
Canlas noted that  “it is like a time-space warp inside Hacienda Luisita where you would feel like the Spanish colonization of the country continuously unfolding and ‘hacenderos’ ruling with ‘whips and iron-fist, slaughtering those who oppose them.”

Philippine Ambassador to Washington Jose Cuisia Jr. is not the only head of mission who holds key positions in major corporations in the Philippines.
The Manila Times found out on Friday that Ambassador to Tokyo Manuel M. Lopez is a director of the board of ABS-CBN, chairman and chief executive officer of the Lopez Holdings Corp. and vice chairman of First Philippines Holdings Corporation (FPHC).
The Lopez Holdings Corp. is the Lopez Group’s flagship for investments. Its main assets are the FPHC and ABS-CBN Corp.
According to the profile posted on Lopez Holding’s website, the envoy is also chairman of the board of Rockwell Land and Bayan and a director of Meralco. Lopez is also a director in the board of Indra Philippines Inc., Sky Cable Corporation and First Philippine Realty Corporation.
President Benigno Aquino 3rd appointed Lopez ambassador in 2010. His appointment stirred controversy after ABS-CBN was highly criticized for its supposed pro-Aquino stance during the last presidential election.
The controversy grew after the President named Manuel Quezon 3rd and Ricky Carandang, former ANC broadcasters, as members of his communications group. ANC is the news channel of ABS-CBN.

 Earlier this week, former Ambassador and The Times columnist Rigoberto Tiglao questioned Cuisia’s retention of memberships on the boards of PhilamLife, Phinma, The Covenant Car Company (Chevrolet) and SM Prime Holdings.
Tiglao said the ambassador religiously attended board meetings. According to Phinma’s and SM Prime’s 2012 annual reports, Cuisia attended six of SM Prime’s meetings and five of Phinma’s.
An ambassador, Tiglao said, couldn’t leave his post that number of times in a year since it will divert his attention from his diplomatic duties.

 The same can be said of Lopez, who attended eight of ABS-CBN’s board meetings last year. This information was sourced from the company’s corporate governance report.
In 2011, the ambassador was present in only two of the 11 ABS-CBN board meetings.
Lopez, however, did not attend the network’s annual stockholders’ meetings in 2011 and 2012.
For FPHC, the ambassador attended four out of the 11 regular board meetings in 2011, as well as that year’s annual stockholders’ meeting.

 Lopez was present at the regular board meetings on March 3, May 5, May 30 and December 1. The annual stockholders’ meeting was also held on May 30.
In Lopez Holdings, where he is chairman, Lopez attended 10 out of 11 board meetings: on January 18, February 28, March 29, June 11, June 19, July 12, August 2, September 17, October 11 and December 13 last year.
As of February 28, Lopez is among the ABS-CBN’s top 20 stockholders, owning 146,186 shares, or equal to 0.02 percent.
But Lopez Inc., whose chairmanship the ambassador holds, owns 446,231,607 shares in ABS-CBN or 57.24 percent. Out of this, Lopez owns 25,288,897 shares.

 Aside from these, Lopez’s posting may be violating Section 23 of the Foreign Service Act of 1991, which orders the mandatory retirement of officers and employees of the department who reach the age of 65.
Lopez is about 71 years old.
Raul Hernandez, Foreign Affairs spokesman, said earlier that political appointees can serve beyond the age of 70.
