WORM’S EYEVIEW: Why discourage assembly or curtail autonomy?

CAGAYAN DE ORO CITY (MindaNews/23 March) — There will be “synchronized” Barangay Assembly meetings nationwide on Saturday, March 29.

It’s unclear how synchronized assemblies promote autonomy or local governance, but it is routine practice now although it has no palpable effect on governing efficiency or proficiency.

In any case, consider these thoughts as you prepare for this week’s assembly.

If you limit the way people exercise discretion, a right, or an entitlement, you dampen creativity
or initiative, encourage laziness or dependency, and discourage autonomy or resourcefulness.

This is what the President unwittingly did when he issued Proclamation No. 260 in September 2011. Through it he decreed that barangays assemble only twice yearly — once on the last Saturday of March and again on the second Sunday of October.

The proclamation attracted little or no attention; not even from Congress. No pork or perks or DAP, I guess. But it was a radical move. It ran counter to Sec. 397 of Republic Act 7160 (the Local Government Code) which states: “The Barangay Assembly shall meet at least twice a year….” which certainly means it may meet more than two times or as often as it wishes.

P-Noy amended the law and no one in Congress gave a hoot!

In his proclamation the phrase “AT LEAST” somehow transmogrified to mean “AT MOST”—which of course was wrong. Compounding the wrong, the Department of the Interior and Local Government (DILG) directed all the 42,000+ barangays of the nation to comply with it year after year. So it subsists to this day and no one seems concerned.

Limiting People Power

What happens now to the right of citizens to convene their Barangay Assembly—which, although admittedly still dysfunctional, is their parliament and legislative governing body?

Composed as it is of all voting residents, this Assembly has superior authority over all officials and units of the barangay government. After all, it’s literally a CONSTITUENT ASSEMBLY! And it has right to convene at any time, as many times as it wishes. But the President says otherwise.

Through Proclamation No. 260 he drastically limits the community’s capability to meet and address local governance issues. Too bad for autonomy and the principle of subsidiarity.

Perhaps it doesn’t occur to the President, or no one tells him, that this Assembly is our local parliament, that it has power to straighten out policy or programs through initiative, as well as power to discipline any official through recall. Powerful!

It also doesn’t seem to strike the President that delimiting or reducing the frequency of barangay deliberations violates the need for free and open exchange of ideas at the grassroots. Does he know that this also constricts the democratic space and strengthens the hand of trapo oligarchs who seek to monopolize or manipulate local governance.

Awaken, Not Deaden, Citizen Initiative!

Someone should tell him that in issuing the Proclamation, he was in violation thrice over: 1) he unilaterally changed the law (Sec. 397 of R.A. 71600) without benefit of congressional action or concurrence; 2) he curtailed the right of citizens to exercise their sovereign right to assemble and engage in deliberative conversations as often as they wish; and 3) he hinders the formation of the popular will on how the local government should proceed with its business (usually expressed in resolutions or declarations after copious debate, discussion, or exchange).

All this was brought home to me during the aftermath of Typhoon Sendong in Cagayan de Oro over three years ago.

Because more than one-third of the city’s barangays were badly punished by Sendong, I thought that it would help the victims greatly if the survivors throughout the city could assemble and regroup. They could then take stock of the damage, the dead, and the missing. But as it happened, they were loath to assemble because they were told that they had already done so two months earlier (in October).

When the DILG Secretary visited the city, our movement suggested that he authorize the Barangay Assemblies to convene so the affected ones could do stock-taking and plan their recovery while the less affected ones could discuss how to marshal their resources to help victims.

To my consternation, the request was denied on the spot. They had already convened twice before Sendong, he said. I explained in vain that that was before and we were now in an emergency, that in any case the law does not limit the number of times a Barangay Assembly can meet, and that the bottom line should be to let the barangaynons decide because it’s their Assembly after all.

All I got for an answer was a look that said, “Mas marunong ka pa sa akin!” as he turned to leave. Beside him at the time was DSWD Secretary Dinky Soliman who could only shrug and flash her signature smile.

In any case, it struck me that the very agency charged with empowering people by promoting the spirit of autonomy or self-governance was preventing the exercise of initiative in victimized communities. I was clearly one of the affected people, and so was the Gising Barangay Movement, but we were ignored! It made me wonder if the attitude reflected the President’s, because it certainly didn’t lift my enthusiasm or that of the people around me.

PhilHealth officials, workers get P1.44B in bonuses despite huge shortfall — CoA

Despite posting a P3.8 billion shortfall in its reserve fund requirement in 2012, officials and employees of the Philippine Health Insurance Corp. (PhilHealth) took home fat paychecks with 22 different bonuses and allowances totaling P1.448 billion.
A report released by the Commission on Audit (CoA) last Oct. 10 stated this which also disallowed all the said bonuses “for lack of legal basis.”
The government auditors said in its report the PhilHealth management has ignored repeated warnings to stop paying its personnel unauthorized stipends based on mere resolutions passed by its Board of Directors.
According to CoA, they have issued notices of disallowance and denial of consolidated appeal of PhilHealth management by the cluster director of Corporate Government Sector (CGS-CoA), management continuously granted the benefits and allowances without obtaining the required approval of the Office of the President.
The fat pay checks of officials and employees included productivity incentive allowance/bonus worth P272.006 million; anniversary bonus, P33.4 million; rice benefit, P106.27 million; educational allowance, P278.89 million; Christmas package, P234.05 million; nominal gift, P10,000; shuttle service assistance, P134.53 million; labor management relation gratuity, P156.92 million; birthday gift, P39 million; medical and mission critical allowance, P23.33 million; corporate transition and achievement premium/grocery allowance, P104.4 million; representation expenses, P32.5 million; and rewards and other claims, P24.74 million.
Likewise, even contractors of the agency were granted “special events gift,” P743,500; project completion benefit, P1,705; gratuity/Christmas package P1.46 million; sustenance gift/rice allowance, P788,400; recognition gift P1.1 million; efficiency/productivity gift, P735,540; alleviation gift, P1.9 million; transportation assistance, P925,748; and medical and mission critical allowance, P68,681.
Not only the top level officials took home the perks because the same incentives were given the same although there was already a warning about the questionable nature of extra-compensation.
“Regional management commented that they extended the benefits by order of the PhilHealth Head Office …(and) that unless there is an order coming from the commission proper denying their appeal, they would continue to grant the same,” auditors said.
But even as PhilHealth personnel took home fat paychecks, CoA reported that the agency posted a whopping P3.68 billion shortfall in “retained earnings (RE)” for 2012, hitting only P115.08 billion against the reserve fund requirement of P118.76 billion.
The CoA warned the viability and sustainability of the National Health Insurance Program is at risk due to the further decline in the RE balance.
The drop was attributed to health cost claims that went up to P12.24 billion last year compared to members’ premium contributions which increased by only P10.57 billion.
Likewise, personnel services and maintenance and other operating expenses went up by P410 million.

2 Ched execs quit, slam Abad for P10B anomaly

Two ranking officials of the Commission on Higher Education on Tuesday submitted their resignation to President Benigno Aquino III after accusing Budget Secretary Florencio Abad and CHED chairperson Patricia Licuanan of allegedly ‘bleeding’ the national coffers dry to benefit a United States university.
CHED Commissioner Nona Ricafort and CHED Director Carmina Alonzo resigned in protest of the “anomalous” P10-billion scientific research project to be based in the US that is being pushed by Abad and Licuanan even “without legal basis” and “without the benefit of public bidding.”
Ricafort and Alonzo said the US did not have counterpart funds and all inventions and discoveries to be made by the research team in the US would carry patents and intellectual property rights according to US laws with the Philippine government not having to own the patents.
“Following recent developments at CHED, it has come to my realization that I will be unable to give my full support to the P10-billion CHED-PCARI (Philippine-California Advance Research Institute) Collaboration Research Project initiated by CHED Chair P. B. Licuanan,” Ricafort told the President in her September 12, 2013 resignation letter, a copy of which was obtained by Manila Standard.
Ricafort acknowledged the PCARI projects were good and directed to uplift the research standard in the Philippines.
“However, I find it difficult to comprehend how to reconcile the magnitude of this collaboration (specifically the budget costing per individual project) to meet the level of perception of the Filipinos, especially the students and their parents, as appropriate answers to their current needs,” Ricafort added.
Ricafort, who had been with CHED for eight years, and Alonzo, lamented the lack of details and legal basis justifying the five-year P10-billion research project.
In her resignation letter dated September 17, 2013, Alonzo said she could not understand why the P10 billion was “parked” with the CHED when basically the jurisdiction falls within the ambit of the Department of Science and Technology “and not the CHED.”
Alonzo, chairman of the Bid and Awards Committee, said while the General Appropriations Act explicitly named the PCARI for the project, the procurement of the engagement for collaboration was “template or tailored-fit” for the University of California Berkley, which she said was “contrary to the bidding process.”
Alonzo said that Abad approved the government funds to be “awarded to private institutions or foundations.”
“It is with reservation that the undersigned is wanting of legal basis or document from the DBM to show that foundations are allowed to use government funds and in this collaboration, it is not the UC Berkley, which will be paid but the individual researchers who are chosen not by the BAC through a bidding process but by the Philippine PCARI focal persons,” Alonzo said.
“How the US-based researchers’ services will be procured is likewise wanting of lawful basis in the same manner that private schools and SUCs (state universities and colleges) may be classified as foundations,” she said.
Alonzo also asked Licuanan to be relieved of any obligation and involvement in the PCARI transactions.
She added that she “personally feel that it is not the opportune time for this project implementation in our country.”
Ricafort furnished the SUCs under her copies of her resignation letter to the President.
