Yolanda victims set deadline for Aquino to heed their plea

The Alliance of Typhoon Yolanda Victims (ABBAT) set a deadline on the Aquino administration to grant their petition for 40,000 cash relief and abolition of the ‘no-build zone’ policy on or before February 14.
ABBAT community leader Patrick Escalona rejected rehab czar Panfilo  Lacson’s option to provide construction materials instead in lieu of the 40,000 cash relief originally meant for daily subsistence of every family. He said the amount is too small to replace the rehabilitation program of the government.
 Sister Edita Eslopor  vowed that they will stage a series of protest rallies until the government heeds their call.
“The massive number of people is proof of their intense discontent over Mr. Aquino’s criminal negligence and utter incompetence in looking after the welfare of the people. This is just the first of a series of protests that will fill the streets of major cities across the country to express our indignation at the Aquino administration,” Eslopor said.
Exactly a week  ago when more than  10 thousand Yolanda survivors from Leyte and Samar staged a protest march in the streets of this city  to express their indignation against the inaction of the national government  on the plight  of the victims of the super typhoon, Malacanang  has yet to act on their demands.
Yolanda survivors under the banner of People Surge laid out specific demands  such as provision and sustenance of food aid, until necessary, to aid full recovery  while source of livelihood  does not stabilize and an immediate provision of P40,000 cash relief for every family   devastated by Yolanda,  during the rally  considered as one of the biggest protest action in the country directed against the Aquino  administration.
According to Dr. Efleda Bautista, a storm survivor herself and current executive vice chairperson of People Surge, instead of directly addressing the problems presented by the Yolanda victims, Presidential spokesperson Edwin Lacierda belittled the series of protests as mere “concerted effort of a few to convince the public that most of our countrymen are dissatisfied with the way the national government  respond to the catastrophe.”
“He  (Lacierda) believes in the very good rating of the president. He is convinced that Yolanda survivors are happy towards P-Noy’s rehab efforts.” Bautista said.
Bautista lambasted  Lacierda’s statement    saying, “The Aquino administration is pathetic for being a die-hard defender of a bogus survey even after survivors from Eastern Visayas—the worst hit region by the typhoon—have spoken of their real condition.”
“With no sense of urgency to respond to ‘Yolanda’ survivors’ demands, this government is victimizing us [‘Yolanda’ victims] all over again,” Bautista lamented.
Eslopor, a Benedictine nun and Chairperson of People Surge, insisted that the Aquino government must have consulted the victims at the onset of any rehab effort.
She said that at the rate by which government implements policies like the ‘no-build zone’, not going through any real consultation among major stakeholders who are the victims, Aquino’s rehab plan is going somewhere else, certainly not towards genuine recovery of typhoon victims.
In another development, two opposition lawmakers on Saturday renewed their appeal for action from the Aquino administration on the plight of the survivors of typhoon Yolanda, saying that the urging from the Catholic Church would also be a ‘voice from Heaven’ that must be heeded.
Gabriela party-list Rep. Luz Ilagan of the Makabayan Bloc and Abakada party-list Jonathan dela Cruz, member of the Independent Minority Bloc in the House of Representatives headed by Leyte Rep. Ferdinand Martin Romualdez, said that the   administration has all the resources needed by the victims, and that every needed assistance for them is possible if only it has the political will to do such .
“Definitely, it’s the Voice of God urging those in power to heed the crisis of a people who suffered from such devastation who continue to suffer from the vagaries of politics,” Dela Cruz told the Manila Standard.
His statement came after Catholic Bishops Conference of the Philippines president Lingayen-Dagupan Archbishop Socrates Villegas appealed to the government as well as  donor-groups to listen to the Yolanda victims and not just provide them with relief or shelter without considering their needs.
Ilagan lamented that the victims are still waiting for government action on them.
Ilagan said that the urging of Villegas is “not only the ‘voice of God’ but also the voice of common sense and good governance.”
She criticized the Aquino government for lacking a comprehensive plan for the victims and survivors of natural calamities.
“Victims cannot rely on relief forever. After relief is the rehabilitation phase to allow the people to return to normalcy as early as possible.  Government’s action or the lack of it gauged by the speed and effectiveness of transition from relief to rehabilitation to rebuild—Obviously, the Aquino administration is short on this,” Ilagan said as she recalled the government’s inaction on the victims of super typhoon Pablo in December 2012 as well as of Zamboanga siege in September 2013. DAVAO City Mayor Rodrigo Duterte on Monday blamed the Government of the Philippines (GPH) peace panel for its failure to include the Moro National Liberation Front (MNLF) in the peace pact with the Moro Islamic Liberation Front (MILF).
“Ang kaning mga taga Manila, mga bugok. Giingnan na nako sila nga do not enter into an agreement with the MILF, forgetting the MNLF (These Manila people – referring to the GPH – are stupid. I told them not to enter into an agreement with MILF and forget the agreement with MNLF). It should be done simultaneously,” Duterte said in his message during the program commending the 911 rescuers held in front of the City Hall on Monday, September 9.
Duterte said this was his “stern warning” given to the government peace panel who sought for his input regarding the peace process sometime ago.

He revealed that he received a call from an official from Malacañang regarding the peace process.
“I gave some but the warning that I stressed, ayaw pakig-areglo sa MILF, if you would just forget the MNLF kay wala pa na ma-perfect (don’t come up with an agreement with MILF because you have not yet perfected the implementation of the peace agreement with MNLF),” he said.
“Ayaw mo ug sulod diha kung dili pa sigurado (Don’t get into that if you’re not sure yet). You will have a problem with (Nur) Misuari,” the mayor quoted what he said to the peace panel.
He said it would be best for the government and the MNLF to go back to the drawing table.
“It’s better to talk for a thousand years than fight a day’s war and lose lives unnecessarily,” he said.
Duterte also said he finally got in touch with Misuari and appealed that tensions not spill over into Davao.
Duterte called for some leaders of the MNLF who are in the city to talk regarding the siege in Zamboanga City.

“I just expressed my concern about the ongoing conflict there because it has resulted into so much violence. Sabi ko kung pwede sana pag-usapan na lang,” Duterte said in an interview.
“I hope we can lessen violence activity. I am against violence whether initiated by government or by Nur,” he said.
Zamboanga City Mayor Isabelle Climaco-Salazar said at least six people died while 24 were wounded in Monday’s clash between government troops and alleged members of the MNLF.

The fighting occurred Monday after troops backed by tanks blocked the MNLF rebels -- armed with assault rifles and grenade launchers – from marching into the Zamboanga City Hall, where they plan to raise their flag to declare independence, said military spokesman Lt. Col. Ramon Zagala.

Lopez foundation rips off gov’t in La Mesa deal—audit

MWSS ends up with empty bag in agreement 
The supposed civic arm of the Lopez Group’s ABS-CBN Corp., ABS-CBN Foundation Inc. (AFI) had appropriated the La Mesa Ecopark operations as its own, denying the Metropolitan Waterworks and Sewerage System (MWSS) its share in a 2001 concession signed between both and the local government of Quezon City.
According to a 2011 report of the Commission on Audit (CoA), state auditors found deficiencies in both the memorandum of agreement (MoA) and memorandum of understanding (MoU) signed among the three for the operation of the ecopark which is also known as the La Mesa Resort Zone.
Under the MoA, a profit sharing of 40 percent of net income for MWSS, 30 percent for AFI and 30 percent for the Quezon City government was agreed on.
The CoA audit showed from 2004 to June 30, 2009, the La Mesa Ecopark operation earned P22 million in net income. “Based on the audited financial statements of the La Mesa Ecopark, the total income for the period 2005 to June 2009 was P20.8 million, hence the share of MWSS should be P8,3 million subject to income tax.
The CoA report, however, stated that the 40 percent share of MWSS on the net income after tax of the project “has not been remitted.”
The CoA also noted that AFI, which is headed by Gina Lopez, a member of the media business clan, had managed to obtain a greater share in the venture than either the MWSS or the QC government, since AFI deducts 15 percent from the gross revenue of the ecopark operations as management fee.
“In managing and operating the La Mesa Ecopark, AFI deducts 15 percent from the gross revenue thereof as management fees. However, no supporting document was presented to show approval by either the MWSS Board of Trustees or La Mesa Executive Board on the 15 percent management fee being charged by the AFI,” according to the CoA.
“Furthermore, with AFI charging another 15 percent management fee on gross revenue over and above the existing profit-sharing of 40 percent as MWSS share, 30 percent each for AFI and LGQC, it would now appear that AFI has a greater share in the revenues and income derived from the operations of the La Mesa Resort Zone,” according to the report.
In the ABS-CBN website, it was stated that “all income generated by La Mesa Ecopark is utilized for the continuous preservation and protection of La Mesa Watershed.”
CoA said a review of the MoU dated Nov. 23, 2001 and MoA (undated) executed by MWSS with AFI and the Local Government of Quezon City had several deficiencies.
It also cited conflicting provisions in the MoU and the MoA signed among the three relative to the Environmental Trust Fund (ETF).
“Section 1 of the MoA provides for the creation at La Mesa Resort Zone – Executive Committee (LMRZ-EC) composed of two representatives each from MWSS, AFI, and the QC government in which the committee shall take the stewardship of the Environmental Trust Fund (ETF) under the control of the MWSS board of trustees (BOT) and under the supervision of the La Mesa Executive Board (LMEB).
“However, under Section 1.a.v of Article IV of the MoU– Management and Operations Framework-the LMEB shall take stewardship and control of the ETF,” according to the report.
The CoA required the MWSS board to clearly designate the stewardship and control of the Environmental Trust Fund.
It added that section 1.2 of the MoA also provided that the LMRZ-EC will be tasked to approve and supervise the implementation of the La Mesa Resort Framework Plan and all programs and plans relative to the operation of the La Mesa Resort Zone. “However, no committee was formed since the inception of the contract,” according to the CoA.
The CoA recommended the creation of the LMRZ-EC that will formulate policies regarding the LMRZ aside from other functions and responsibilities stated in the MoA.
“Upon creation, members of the proposed body should convene regularly to address and assess the operations and concern of the LMRZ/La Mesa Ecopark,” it said.
The CoA also cited section 6 of the MoA that required all funds generated from the operation of the LMRZ should be deposited under a special account for the Environmental Trust Fund (ETF) to be opened in the name of MWSS, AFI and the Quezon City government “and any or all transactions or withdrawal involving the ETF shall be considered approved if signed and approved by at least two official representatives or signatories of either MWSS and AFI, or MWSS and LGQC.”
CoA said, however, documents showed that all accounts were opened in the name of AFI only and “transactions/withdrawals were made without the consent of MWSS.”
The CoA said that the parties involved in the agreement should comply with the provisions of section 6 of the MoA “to maintain sound internal controls by opening an account in the name of the three contracting parties.”
“All transactions shall be authorized with the consent of MWSS representative,” the CoA added.
It also cited violations of section 22 of the MoA that mentioned four requisites for the agreement to be effective which were that the MoA shall be signed by the parties; approved by proper authorities; and reviewed by the Office of the Government Corporate Council (OGCC) and ratified by the QC Sanggunian.
“Requisites 2 and 4 were not complied with. There was no MWSS resolution approving the MoA as per certification by the Board Secretariat of MWSS. Also, the contract was not ratified by the QC Sanggunian as confirmed by Mr. Francisco Mallillin to IAD Manager Bienvenido A. Sarmiento based on the report of Virgilio P. Matel, Officer-in-Charge of the Internal Audit Department during that time,” the CoA said.
The CoA said the MWSS should require the post facto approval and ratification of the MoA to enable the agreement to be fully effective.
“Otherwise, the MoA could be considered null and void,” it added.
The CoA also noted that the 40 percent share in the net income generated from La Mesa Ecopark operation (La Mesa Resort Zone) was not recorded in the books of the MWSS pursuant to section 11 of the MoA among the parties involved.
“Section 11 of the MoA requires that financial report shall be prepared and submitted by the AFI to the La Mesa Executive Board (LMEB) from its initial operation ending June 30, 2005 and the annual financial report thereafter and the income shall be distributed among the parties accordingly,” CoA added.
The AFI, however, failed to submit the annual financial report as required in the MiA.
“Finally, on Nov. 5, 2009, the Internal Audit Department (IAD) of MWSS received the audited Financial Statements of La Mesa Ecopark/Watershed Operation covering the period 2004 to June 30, 2009 or a period of five years,” it said.
The CoA noted that based on financial report, included in the direct expenses was the 15 percent management fee charged by the AFI amounting to P20.5 million for five and a half years “whereas the 40 percent  share of MWSS on the net income after tax has not been remitted as of today.”
The CoA tasked the MWSS to require the AFI to submit the annual financial report and remit the corresponding share of income to the MWSS.
“The books of account of the La Mesa Ecopark should be made available to the duly authorized representative of MWSS as required under Section 12 of the MoA,” it added.

First there was a denial from Malacañang that there was a firefight as well as the fighters of Kiram   being killed.
But in the aftermath of the firefight that ensued in Lahad Datu, Sabah between the Kiram clan of the Sultanate of Sulu and the Malaysian troops which resulted in a number of deaths, President Aquino and his propagandists in Malacanang were clearly trying to control the impact of shocking gunfire heard over the radio in southern Mindanao and Metro Manila.
Twelve Filipino followers of a self-proclaimed sultan died in a shootout with Malaysian security forces Friday, police told AFP after a 17-day standoff.
Sabah state police chief Hamza Taib said that in addition to two police officers killed, “three were injured and... 12 intruders died” in the firefight.
National news agency Bernama also quoted Prime Minister Najib Razak as saying he had received reports that 10 to 12 people from the armed group were killed.
Worse, Malacañang was placing all the blame on Kiram’s men, taking as gospel truth the version of Malaysia, that it was Kiram’s group that fired first.
The Malaysian Star newspaper initially reported that, at least, two police commandos were killed and four policemen injured after police started their operations on the Sulu gunmen following a standoff which started on Feb 9.
Bernama reported that the commandos were killed in a mortar attack after police moved in at the Tanduo village on Friday.
Condemning the violence that erupted in Sabah between followers of the Sultan of Sulu and Malaysian forces yesterday, UNA senatorial candidate Richard Gordon sympathized with the families of the Muslim Filipinos who have been killed and wounded in the conflict.
Gordon described the Aquino administration’s handling of the crisis in Sabah as “severely woeful, anti Filipino, and subservient to Malaysia.”
Gordon said  a bloody encounter could have been avoided and should never have happened.
He questioned the manner by which foreign affairs officials handled the situation and advised the President.
Gordon said that the DFA should be at the forefront of the matter and must never compromise the President of the Philippines by allowing him to comment on such issues.
“Should not our ambassador to Malaysia have been the one at the frontline?  Or our DFA officials?” Gordon asked.
He further questioned the lack of attention, priority and importance given to Sultan Kiram’s letters to the President.
“And what about our intelligence officials?  How is it that no one even knew that a large number of Filipinos were headed to Sabah?” Gordon continued.
“Whoever is advising the President on foreign policy matters has done terribly wrong by our people and has put us on a slippery slope with regard to this conflict,” he continued.
According to Gordon, the government sent the wrong signal to the Malaysian government when it portrayed the Filipinos pursuing the claim on Sabah as  common criminals. It is the president’s duty to protect its citizens everywhere.
Gordon said, “The Malaysians were allowed to think by our own authorities that Filipinos are expendable.
“This issue should have been more carefully handled by our foreign affairs officials, but clearly foreign policy and crisis management have not been the strong suit of this administration,” Gordon said.
President Aquino who was in San Fernando City, Pampanga when the firefight took place told his audience that he was monitoring the developments in Sabah.
“Please forgive me if I do go up and down of the stage. As you know, there is something that transpired in Sabah right now. It seems it was already done,” Aquino said.
Aquino said that the  details of the firefight relayed to him are not yet officially complete as to the number of deaths.
“The details are not yet complete. We have to hurry in going back as we expect that upon our arrival  in the office, all the necessary information is already complete,” Aquino said.
Presidential deputy spokesman Abigail Valte, minutes after the firefight ensued, held a press conference in Malacañang, claiming that there was no firefight between the Kirams and the Malaysian authorities.
Valte also down played initial reports about the number of casualties and injuries in the firefight later.
“First, we would like to make it clear that there was no gunfight or a firefight happened. Second, there was someone who fired a warning shot. And the two persons were detained. But our information was that these two were returned,”  Valte said.
Valte said there was an attempt from the group to get out of their cordoned area near the security forces of Malaysians.
“So, our information and what we have verified was that there was an attempt from the Kiram group to go out of the cordoned area to get near the area of the security forces of Malaysia,” Valte said.
Three people including two police officers were killed Friday as Malaysian security forces ended a stand-off with Filipino gunmen over a territorial dispute in Sabah, the Philippine government said.
Dozens of followers of the little-known sultan of Sulu had been facing off with Malaysian police for the past two weeks, after they sailed from their homes in the southern Philippines to stake a territorial claim in Malaysian Borneo.
The 74-year-old Jamalul Kiram III says he is the head of the Islamic Sultanate of Sulu, which once controlled parts of Borneo including the site of the stand-off, as well as southern Philippine islands.
The owner of the house where the leader of the gunmen stayed during the 17-day stand-off was also killed but the nationality was not known, foreign department spokesman Raul Hernandez told reporters, citing a report by Malaysia’s ambassador.
A third Malaysian police officer was wounded after the gunmen opened fire on their van, he said.
“The Malaysian ambassador said that the rest of the Kiram group in Lahad Datu escaped and ran toward the sea,” he said, adding that 10 members of the group were arrested.
An official at the main hospital in the town of Lahad Datu near the site of the stand-off told AFP two police officers had been brought in with gunshot wounds but were in stable condition.
Hernandez said he could not confirm allegations by a Manila spokesman for the gunmen that Malaysian security forces had shot dead 10 members of the group and wounded four others.
Hernandez said Manila had formally demanded a full account of the security operation that ended the stand-off.
Kiram’s spokesman Abraham Idjirani claimed Malaysian snipers had killed 10 of the sultan’s men and wounded four other members of the group.
“I talked to (the group’s leader) by telephone just now and asked him how many of his men were martyred. He told me 10. I inquired about the wounded and he said four,” Idjirani told a news conference at Kiram’s Manila home.
Idjirani insisted Kiram’s men would continue to fight and would not leave Sabah.
The Islamic Sultanate of Sulu leased northern Borneo to Europeans in the 1870s.
While the sultanate’s authority gradually faded as Western colonial powers exerted their influence over the region, it continued to receive lease payments for Sabah.
The former British colony became part of the federation of Malaysia when it was formed in 1963.
Kiram and the other heirs of the sultan still receive nominal annual compensation from Malaysia in the equivalent of about $1,700.
Idjirani suggested last week that the men would stand down if the compensation were substantially raised.
Members of the Malaysian police assaulted the group of Raja Muda Agbimmudin Kiram, a brother of Sultan Jamalul Kiram III of Sulu, in a village they occupied in Lahad Datu, Sabah.
Malaysia says it was the Kiram group that fired first and the Palace is buying that line.
The camp of Sultan Kiram claimed that 10 of his followers were killed, including a mother of two children, while four others were wounded after Malaysian forces assaulted the Filipinos holed up in Tanduao village in Lahad Datu.
Abraham Idjirani, spokesman of the Sulu sultanate, said that firefight broke out at around 10 a.m. when members of the Malaysian police commando attacked the group of Raja Muda Agbimmudin Kiram,  who led more than 200 of their followers in occupying a village in Lahad Datu since Feb. 12.
The camp of Sultan Kiram claimed that Malaysian forces fired first at the group of Raja Muda. Idjirani said the Filipinos were subjected to sniping by the Malaysian commando.
Idjirani claimed that based on the information received from Raja Muda himself, 10 of his followers, including a 28-year-old woman with to two children, were killed while four others were wounded.
He said that only two of the fatalities were identified but he refused to identify them.
Idjirani also denied reports that Raja Muda has been wounded and arrested during the assault. He claimed that Raja Muda, who is the Crown Prince, is in constant communication with Sultan Kiram.
The DFA, in a press conference, announced that the Malaysian Embassy informed them that the standoff was over as of yesterday afternoon.
The DFA said that the Malaysian government said that the attack resulted in the killing of three people –two Malaysian police and the owner of the house occupied by Raja Muda’s group. Ten other Filipinos reportedly surrendered.
The DFA said it has yet to confirm the reported killing of 10 followers of Raja Muda.
Meanwhile, senatorial wannabe retired Maj. Gen. Ramon Montano, former chief of the defunct Philippine Constabulary, said that the Aquino government should denounce the “aggression” against the Filipinos.
“The Philippine government should condemn the use of military force and aggression to resolve the issue,” said Montano.

Secondly, you bamboozled the previous CHIEF JUSTICE of the Supreme Court. Ipinahiya mo, sinira mo ang pangalan and you "proclaimed" him guilty of hiding his hard earned money.Without even showing evidence that he robbed the government coffers of money during his stint as Chief Justice. Third, pagpalagay na natin corrupt nga si Gloria, pero why is it that you have prevented her departure at the NAIA when the Supreme Court had already allowed her liberty to travel by virtue of an order. It was a Supreme Court order. It was not some piece of paper with scribbles on it. It was the duty of Secretary Delima to have exhausted all the necessary means at her disposal during the time to determine and validate if such an order were issued. It was a Supreme Court decision. It was jurisprudence. It was the law that every one of us, people, from all walks of life from peddlers, taxi drivers, salesmen, doctors, engineers, everybody including you and me, are subject thereto. Yet, brazenly, without due regard for the RIGHTS OF the people that I have mentioned, it continues to send a SIGNAL to many of us that you are wielding your POWER CRUELLY. 

If you can do it to a Chief Justice and to a former President who has for her own credit made good contribution to the economy that you had been bragging about, then we consider ourselves inconsequential. 

Fourth, the economy is still hurting. Many people, graduates have no jobs. Yet you find it easy to extend a 1 Billion Dollar Credit to the IMF. Where is the morality that you have been talking about NOY?

Daang Matuwid? Helping other countries first before us, before Filipinos?

Fifth, you gave money to the MILF and ABB. Why Noy? What have they done to help the economic plight of the Filipinos? Sa pakikipagbaka ba nila, nakakapagbigay ba sila ng tulong sa mga mamamayan?

This is DEGENERATE to the infinite degree. Inuna mo pa sila kaysa sa amin. 
Compared to MILF, you should have helped Misuari, the lesser evil in the game of chess. At least siya, HE LAYED DOWN HIS ARMS AND PLAYED CIVILIAN. He did not antagonize people and regions anymore. By being a citizen of the republic,he has made himself virtually a subject of the Philippine law. The MILF did not even respect the law. Yes they were brave but they were killers. Why did you give them so much? You did not even consult the people of Mindanao. You see, people there share common heritages. Christians, Lumads and Muslims. You made arbitrary moves that may one day even factionalize this nation. 

Sa katakawan ninyo at ng angkan mo, gusto mo mapa sa inyo pa ang GOLD, COPPER, NICKEL, OIL, GEOTHERMAL and agricultural resources ng Mindanao. You even offered Mindanao.  to the American Armed Forces so they could operate there with impunity.

And now, nasa Cebu ka na naman. Kay Garcia. Bakit, akala mo hindi lalaban ang mga Cebuano sa iyo? They killed Magellan in 1521. Cebuanos are strong and sturdy people and they resent it so much that people like you presume to know what they think.

There are many more issues Aquino. You have failed to see and appreciate our values. We, who once thought that you, YOU would actually improve our way of life. Yet, you took our property, our pride and our dignity. 

Next year, marami na namang increases. From taxes, tolls and fees. Yet less salaries, benefits and livelihood programs for the people. Across the nation, many people are already disappointed with you. We thought that you were better than GLORIA. Now, it appears  that even if we don't exactly like her,  GLORIA respected the BUREAUCRACY, the people, the economy and the system more. 

Noy, you are a violator of the Law. You are a traitor to our sense of nationhood. And you are an irresponsible leader much less a politician. You are no friend to to us and no friend to the lowliest people that comprise the face of this country. 

You are an elite. And you have no recognized platform in governance. For that we believe that it is time to step down.

Step down Noy. It's about time. Because if you don't, you may find yourself at the bottom's end of the people's wrath. 

Do not underestimate our sensibilities. And our CAPABILITIES. What we cannot do with water, we may put out through fire.

As I've said it is TIME.
