Comelec to hold plebiscite for creation of Davao Occidental

THE Commission on Elections (Comelec) will hold a plebiscite for the creation of the new province of Davao Occidental, simultaneous with Barangay and Sangguniang Kabataan (SK) elections on October 28.
According Commissioner Christian Robert Lim, holding the plebiscite together with the village and youth polls will save the poll body some P29 million since they will only spend more than P11 million. At least P40 million is needed to hold a separate plebiscite.
On July 23, 2013, Congress enacted Republic Act (RA) 10360 or an "Act Creating the Province of Davao Occidental."
A total of 523,862 registered voters (as of the May 13, midterm polls) of Davao del Sur, excluding Davao City, will participate in the plebiscite that will determine whether the new province will be created or not.
The proposed province will be composed of the municipalities of Sta. Maria, Malita, Don Marcelino, Jose Abad Santos and Sarangan. The five municipalities were carved out from the eight municipalities in the second legislative district of Davao del Sur.
Lim said the voters in the said province will be using a longer ballot since it would include voting for the creation of Davao Occidental. Voters will be asked to answer the question by yes or no.
In RA 10360, the poll body is mandated to supervise the conduct of a plebiscite for the approval of the creation of Davao Occidental by the majority of the votes cast by voters in the affected areas, within 60 days after the law becomes effective.
However, the Comelec on November 27, 2012, suspended the conduct of all plebiscite as a matter of policy in view of the preparations for the May 13, 2013 National and Local Elections. The policy of deferment was later extended on July 9, 2013.
On July 31, 2013, the poll body approved the holding of the plebiscite.

Aquino signs law creating Davao Occidental

MANILA, Philippines - President Aquino has signed into law a measure creating the province of Davao Occidental, formerly Davao del Sur, which consists of five towns.
 The capital town and seat of government of  Davao Occidental will be the municipality of Malita. Don Marcelino, Jose Abad Santos and Saranggani also form part of the province.
Republic Act 10360 states that incumbent representatives and other local officials  of Davao del Sur shall continue their term of office.
The President also signed RA 10359, declaring March 26 of every year as a “special working holiday” in the province of Cebu in commemoration of its liberation from  the Japanese during World War II.
The President signed on Jan. 9 RA 10355, which  doubles the bed capacity of the  Jose Lingad Memorial General Hospital in San Fernando City in Pampanga from 250 to 500.

On July 23, 2013, Congress enacted Republic Act 10360 or an “Act Creating the Province of Davao Occidental.” Carved out from the present Davao del Sur, the new province consists of the Municipalities of Sta. Maria, Malita, Don Marcelino, Jose Abad Santos, and Sarangani.

In RA 10360, the COMELEC was mandated to supervise the conduct of a plebiscite for the approval of the creation of Davao Occidental by the majority of the votes cast by voters in the affected areas, within sixty (60) days after the Act becomes effective.

However, the COMELEC on November 27, 2012, suspended the conduct of all plebiscite as a matter of policy in view of the preparations for the May 13, 2013 National and Local Elections. The policy of deferment was later extended by the COMELEC on July 9, 2013.

The poll body in a meeting held on July 31, 2013, then decided to hold the plebiscite for the creation of Davao Occidental simultaneous with the October 28, 2013 Barangay and Sangguniang Kabataan Elections.

According to the COMELEC, five out of the eight municipalities in the 2^nd Legislative District of Davao del Sur shall compose the new Province of Davao Occidental, once approved in a plebiscite.

The registered voters of Davao del Sur, excluding Davao City, shall participate in the said plebiscite. As of the May 13, 2013 National and Local Elections, Davao del Sur, excluding Davao City, has 523,862 total number of registered voters, the poll body furthered.

Voters in Davao del Sur shall use a different ballot in the October 28, 2013, Barangay and SK Elections as it would also include voting for the plebiscite. The COMELEC shall be printing special ballots for the purpose.

1002nd Bde protects Danding Cojuangco in Malita, Davao del Sur

The 1002nd Brigade of the Philippine Army serves as the protector of big bourgeois comprador Eduardo “Danding” Cojuangco in Malita town, Davao del Sur. Colluding with Cojuangco in sowing terror and raking in huge amounts of money from various businesses in Malita is the town mayor Franklin Bautista.
Hundreds of hectares of banana plantations are owned by the Cojuangcos in Malita and the same goes for the Bautistas. They continue to expand their plantations by deceiving the peasants or violently seizing their land. Currently, their main instruments in seizing vast tracts of land are the 39th and 73rd IB of the 1002nd Brigade.

Violence marks the Cojuangcos and Bautistas’ landgrabbing schemes. Seven persons were killed and hundreds were wounded in Tarlac when the Cojuangcos’ armed minions opened fire on striking farm workers in 2004. More than 20 persons have been killed by the Bautistas in the past several years in the town of Malita.
Malita’s upland areas and its neighboring towns are being targeted for mining operations. One of the companies with a pending mining application is Looc Mining which is also owned by the Cojuangcos.
Heavy military presence and the AFP’s “peace and development initiatives” have turned Malita into a virtual military garrison. The AFP imposes martial law through killings, food blockades, checkpoints, limits on the working hours and food brought by farmers going to their fields, interrogations, repeated harassment and maulings of civilians.
In 2011, four civilians were killed by the 39th and 73rd IB in Malita, with two of the victims slain in an exceptionally brutal way. They were hung on trees, hacked, stabbed and shot multiple times. These two battalions are notorious for human rights violations. Their crimes are brazen violations of the provisions of international humanitarian law and the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL).
Alongside such violence is the deception foisted on the people through Oplan Bayanihan (OPB). Under OPB, the military conducts “peace building seminars and rallies,” the latest of which was held on February 25-27. About 200 people who had allegedly “strayed” and had now returned to the fold of the reactionary government were paraded before the public as surrenderees. In fact, they were civilians herded by the military from five interior villages of Malita.
Bautista and the 1002nd Bde also gave away P200,000 and a few goats to the “surrenderees” as a reward for returning to the government’s fold.
The people of Malita are intensely repulsed by such highly insulting actions by the reactionary government and the 1002nd Brigade. Because of Oplan Bayanihan, poverty, violence and the lack of democracy have worsend in Malita town. This has encouraged its residents to join and support the people’s war.

Congress probe urged on Ballsy extort try 

 The alleged involvement of one of the sisters of Noynoy in an irregular deal comes not as a surprise since the four Aquino siblings has been active in the daily affairs of their brother from his haircut down to the clothes he wears for the day.
So why not a slice of the action since Noynoy still has three years left in his presidency?
The alleged involvement of Ballsy Aquino Cruz and Noynoy’s brother-in-law Eldon Cruz and their group, in the contract for the supply of coaches for the metro rail transit (MRT) which is the one that traverses the Epifanio de los Santos Ave (Edsa) that is a key road for the Aquinos since this is where the People Power assembly that had installed former President Cory Aquino, Noynoy’s mother, happened.
The persons said to have been helping the two in swinging the deal with Inekon, a Czech manufacturer of train equipment, are all family allies, and the name of a Lopez brother in law, Steve Psinakis, is also alleged to be in the inner group of Ballsy and husband.
Pete Prado was the Philippine National Railways (PNR) general manager during Cory’s term and Steve Psinakis was the chief conduit of the Aquinos with the Lopez family which runs a business empire the fate of which, in turn, hinges on an Aquino heading the government.
The allegations against Ballsy Cruz will also put to test the resolve of Noynoy on his “tuwid na daan” (righteous path) hype, which the longer that Noynoy stays in power, the more it is seen as a mere advertising slogan.
The details are not as sketchy as Aquino’s mouthpiece Abigail Valte claimed they are, since the main personages and the company they are brokering with plus the amount of commissions, from $2 million to $20 million in “facilitation fees,” were all identified in the report about the irregularity.
Valte also claimed the Aquino sisters were “far-removed” from the affairs of the government and should not be embroiled in allegations of anomalies particularly since the charges started from a blind item that had appeared in a newspaper.
The Ombudsman, however, is empowered to act on such blind items that implicates a government official going by the Ceasar’s wife rule.
The Ombudsman, however, cannot run against Ballsy since Aquino’s sister is not a public official, but it behooves Noynoy to follow the same principle in having the allegations investigated.
The main criticism on Cory Aquino was maintaining a so-called Kamag-anak Inc. which goes into action each time a juicy contract is entered into by the government.
Under Noynoy, the set up was resurrected and brought nearer to home under a revival.
The Czech deal may very well signal the Kamag-anak Inc.’s coming out in full force in the final years of Noynoy the same way that the last years of Cory Aquino had many of the Cojuangco-Aquinos getting into the act on some of the more juicy government contracts.
The Anti-Graft and Corrupt Practices Act addresses the involvement of the Aquino sister in the Czech contract.
In Section 5 of the law it was stated that “It shall be unlawful for the spouse or for any relative, by consanguinity or affinity, within the third degree, of the President of the Philippines, the Vice President of the Philippines, the President of the Senate, or the Speaker of the House of Representatives, to intervene, directly or indirectly, in any business, transaction, contract or application with government.”
In the Time magazine commentary on naming Noynoy among the 100 most influential individuals in the world, it said that Ballsy should have been Noynoy’s nickname for his courage against corrupt practices.
So let’s see who Ballsy really is.

MANILA, Philippines - Malacañang on Friday dismissed reports that presidential sister Ballsy Aquino and husband Eldon Cruz are extorting money from a company in exchange for government contracts.
Deputy presidential spokesperson Abigail Valte denied the allegation, which has already reached President Benigno Aquino III.
“One, everybody knows that the presidential sisters are very far removed from the affairs of government. Napaka-murky ho ng storya at halata naman pong talagang ito’y conjecture or gawa-gawa lamang," said Valte.
The Palace official said the allegation started as a mere blind item in the media.
"Hindi sa pinagkibit-balikat [ni Presidente] pero... at this point, it does not even merit a response given the obscurity of the details that are supposedly part of the story," Valte said.
Reports said the group of Aquino-Cruz was allegedly involved in an extort attempt against a Czech company that is supposedly among the bidders for the new coaches of the Metro Rail Transit.

There is one thing that many of us Filipinos hate so much NOY. And that is being UNDERESTIMATED. 

Simula ng pag-upo mo, you did almost nothing to alleviate the plight of many of us including the middle class people and workers. First, nag-rationalize ka. Marami sa amin tinanggalan mo ng mga hazard pay at mga allowances. Yan na nga lang kinakain namin sa pang-araw araw lalo na't sa mga anak namin, kinuha niyo pa sa ngalan sa RATIONALIZATION. Masyado kayong nagmabilis kumuha ng pera sa aming mga workers pero hindi ninyo tinututukan ang tax collection ang mga taong kaibigan ninyo katulad ni LUCIO TAN na may naka binbin na multi-million tax evasion cases sa Court at BIR. It shows that you bully small people like us. some of us even supported you and spent their small share of money during your candidacy.

Secondly, you bamboozled the previous CHIEF JUSTICE of the Supreme Court. Ipinahiya mo, sinira mo ang pangalan and you "proclaimed" him guilty of hiding his hard earned money.Without even showing evidence that he robbed the government coffers of money during his stint as Chief Justice. Worse, you allowed the exposure of his account in the proceedings without his authority and consent.

Third, pagpalagay na natin corrupt nga si Gloria, pero why is it that you have prevented her departure at the NAIA when the Supreme Court had already allowed her liberty to travel by virtue of an order. It was a Supreme Court order. It was not some piece of paper with scribbles on it. It was the duty of Secretary Delima to have exhausted all the necessary means at her disposal during the time to determine and validate if such an order were issued. It was a Supreme Court decision. It was jurisprudence. It was the law that every one of us, people, from all walks of life from peddlers, taxi drivers, salesmen, doctors, engineers, everybody including you and me, are subject thereto. Yet, brazenly, without due regard for the RIGHTS OF the people that I have mentioned, it continues to send a SIGNAL to many of us that you are wielding your POWER CRUELLY. 

If you can do it to a Chief Justice and to a former President who has for her own credit made good contribution to the economy that you had been bragging about, then we consider ourselves inconsequential. 

Fourth, the economy is still hurting. Many people, graduates have no jobs. Yet you find it easy to extend a 1 Billion Dollar Credit to the IMF. Where is the morality that you have been talking about NOY?

Daang Matuwid? Helping other countries first before us, before Filipinos?

Fifth, you gave money to the MILF and ABB. Why Noy? What have they done to help the economic plight of the Filipinos? Sa pakikipagbaka ba nila, nakakapagbigay ba sila ng tulong sa mga mamamayan?

This is DEGENERATE to the infinite degree. Inuna mo pa sila kaysa sa amin. 
Compared to MILF, you should have helped Misuari, the lesser evil in the game of chess. At least siya, HE LAYED DOWN HIS ARMS AND PLAYED CIVILIAN. He did not antagonize people and regions anymore. By being a citizen of the republic,he has made himself virtually a subject of the Philippine law. The MILF did not even respect the law. Yes they were brave but they were killers. Why did you give them so much? You did not even consult the people of Mindanao. You see, people there share common heritages. Christians, Lumads and Muslims. You made arbitrary moves that may one day even factionalize this nation. 

Sa katakawan ninyo at ng angkan mo, gusto mo mapa sa inyo pa ang GOLD, COPPER, NICKEL, OIL, GEOTHERMAL and agricultural resources ng Mindanao. You even offered Mindanao.  to the American Armed Forces so they could operate there with impunity.

And now, nasa Cebu ka na naman. Kay Garcia. Bakit, akala mo hindi lalaban ang mga Cebuano sa iyo? They killed Magellan in 1521. Cebuanos are strong and sturdy people and they resent it so much that people like you presume to know what they think.

There are many more issues Aquino. You have failed to see and appreciate our values. We, who once thought that you, YOU would actually improve our way of life. Yet, you took our property, our pride and our dignity. 

Next year, marami na namang increases. From taxes, tolls and fees. Yet less salaries, benefits and livelihood programs for the people. Across the nation, many people are already disappointed with you. We thought that you were better than GLORIA. Now, it appears  that even if we don't exactly like her,  GLORIA respected the BUREAUCRACY, the people, the economy and the system more. 

Noy, you are a violator of the Law. You are a traitor to our sense of nationhood. And you are an irresponsible leader much less a politician. You are no friend to to us and no friend to the lowliest people that comprise the face of this country. 

You are an elite. And you have no recognized platform in governance. For that we believe that it is time to step down.

Step down Noy. It's about time. Because if you don't, you may find yourself at the bottom's end of the people's wrath.
