Customs employees oppose return-to-mother-unit order

MANILA, Philippines – Bureau of Customs (BOC) employees are strongly opposing an order crafted by the Department of Finance's newly formalized Revenue Cluster ordering them to return to their mother units.
In a statement, the BOC Employees Association (BOCEA) said the order will result in "massive dislocation, displacement and abandonment of functions" that may paralyze BOC operations.
"Such order caused restiveness and anxiety among the rank-and-file employees of the Bureau of Customs who are all in a quandary why did the Commissioner of Customs is again turning the guns on the lowly rank-and-file employees," said the group.
The Revenue Cluster headed by Bureau of Internal Revenue (BIR) Commissioner Kim Henares issued Customs Personnel Order (CPO) B-134-2013, mandating all BOC employees to return to their mother units, effectively revoking their current assignments. The cluster covers the BIR, BOC and the Bureau of Local Government Finance. The order was signed by BOC Commissioner Ruffy Biazon and approved by DOF Secretary Cesar Purisima.
BOCEA said Biazon is "ill-advised."
"This will gravely affect the security of tenure, basic rights of the employees under the Constitution and the welfare and interest of the whole rank-and-file employees," it said.
Henares said the order is just the first in a series of reforms that the Revenue Cluster will implement at the BOC, which President Benigno Aquino III singled out in his 4th State of the Nation Address for rampant corruption.
She maintained it is meant to put things at the agency in order. She said employees should be at their "plantilla" posts or where they were originally appointed.
The first batch of employees affected by the CPO included Supervising Customs Operating Officers and Customs Operations Officers III. These officers were relieved of their assignments on September 13, Biazon said in the CPO.
The second batch covered all Chief Customs Operations Officers and Customs Operations Officers V, whose designations were revoked on September 15.
“All officials and employees who are affected by the CPO have 10 days to report to their permanent units. By September 27, 2013, all employees of the BOC should be back at their respective permanent positions,” Biazon said.
"Failure to report to original/permanent units on or before the designated deadline may be grounds for administrative sanctions," he added.
No plantilla posts?
As expected, there are difficulties in implementing the order.
In a September 13 memorandum to Biazon, BOC Director for Administration Ma. Corazon Azana listed down several units and offices that do not have plantilla positions and hence will be left with no manpower.
Some Customs offices and ports have plantilla positions, but these are already inactive, Azana also said. "Recalled personnel have no office or port to report to."
These offices include BOC's Water Patrol Division, Radio Communication Division, Subport of Tabaco, Subport of Jose and the Food Terminal Inc. Customhouse.
More to come
Henares stressed that the CPO was a product of joint efforts to reform the BOC.
“It’s a joint effort of DOF and Customs,” she said.
The Revenue Cluster vowed to carry out sustainable reforms to institutionalize integrity in the BOC, curb smuggling, and plug tax leaks.
A Finance official said there will be "second and third waves" after the issuance of the CPO.
The official said among the changes planned is the transfer of some ranking Customs official to the DOF.
The biggest task at hand however is modernizing Customs procedures, said Biazon.
Changes at the BOC have the blessing of President Aquino. "All of these have clearance from the President," said Henares. – Rappler.com

Congress probe urged on Ballsy extort try 

 The alleged involvement of one of the sisters of Noynoy in an irregular deal comes not as a surprise since the four Aquino siblings has been active in the daily affairs of their brother from his haircut down to the clothes he wears for the day.
So why not a slice of the action since Noynoy still has three years left in his presidency?
The alleged involvement of Ballsy Aquino Cruz and Noynoy’s brother-in-law Eldon Cruz and their group, in the contract for the supply of coaches for the metro rail transit (MRT) which is the one that traverses the Epifanio de los Santos Ave (Edsa) that is a key road for the Aquinos since this is where the People Power assembly that had installed former President Cory Aquino, Noynoy’s mother, happened.
The persons said to have been helping the two in swinging the deal with Inekon, a Czech manufacturer of train equipment, are all family allies, and the name of a Lopez brother in law, Steve Psinakis, is also alleged to be in the inner group of Ballsy and husband.
Pete Prado was the Philippine National Railways (PNR) general manager during Cory’s term and Steve Psinakis was the chief conduit of the Aquinos with the Lopez family which runs a business empire the fate of which, in turn, hinges on an Aquino heading the government.
The allegations against Ballsy Cruz will also put to test the resolve of Noynoy on his “tuwid na daan” (righteous path) hype, which the longer that Noynoy stays in power, the more it is seen as a mere advertising slogan.
The details are not as sketchy as Aquino’s mouthpiece Abigail Valte claimed they are, since the main personages and the company they are brokering with plus the amount of commissions, from $2 million to $20 million in “facilitation fees,” were all identified in the report about the irregularity.
Valte also claimed the Aquino sisters were “far-removed” from the affairs of the government and should not be embroiled in allegations of anomalies particularly since the charges started from a blind item that had appeared in a newspaper.
The Ombudsman, however, is empowered to act on such blind items that implicates a government official going by the Ceasar’s wife rule.
The Ombudsman, however, cannot run against Ballsy since Aquino’s sister is not a public official, but it behooves Noynoy to follow the same principle in having the allegations investigated.
The main criticism on Cory Aquino was maintaining a so-called Kamag-anak Inc. which goes into action each time a juicy contract is entered into by the government.
Under Noynoy, the set up was resurrected and brought nearer to home under a revival.
The Czech deal may very well signal the Kamag-anak Inc.’s coming out in full force in the final years of Noynoy the same way that the last years of Cory Aquino had many of the Cojuangco-Aquinos getting into the act on some of the more juicy government contracts.
The Anti-Graft and Corrupt Practices Act addresses the involvement of the Aquino sister in the Czech contract.
In Section 5 of the law it was stated that “It shall be unlawful for the spouse or for any relative, by consanguinity or affinity, within the third degree, of the President of the Philippines, the Vice President of the Philippines, the President of the Senate, or the Speaker of the House of Representatives, to intervene, directly or indirectly, in any business, transaction, contract or application with government.”
In the Time magazine commentary on naming Noynoy among the 100 most influential individuals in the world, it said that Ballsy should have been Noynoy’s nickname for his courage against corrupt practices.
So let’s see who Ballsy really is.

MANILA, Philippines - Malacañang on Friday dismissed reports that presidential sister Ballsy Aquino and husband Eldon Cruz are extorting money from a company in exchange for government contracts.
Deputy presidential spokesperson Abigail Valte denied the allegation, which has already reached President Benigno Aquino III.
“One, everybody knows that the presidential sisters are very far removed from the affairs of government. Napaka-murky ho ng storya at halata naman pong talagang ito’y conjecture or gawa-gawa lamang," said Valte.
The Palace official said the allegation started as a mere blind item in the media.
"Hindi sa pinagkibit-balikat [ni Presidente] pero... at this point, it does not even merit a response given the obscurity of the details that are supposedly part of the story," Valte said.
Reports said the group of Aquino-Cruz was allegedly involved in an extort attempt against a Czech company that is supposedly among the bidders for the new coaches of the Metro Rail Transit.

US assets not included in SALn makes her liable for graft, perjury 
Re-electionist Sen. Loren Legarda was one of 20 senators who had voted to convict impeached Chief Justice Renato Corona for not declaring his dollar accounts as well as his properties where he failed to state the acquisition cost in his Statement of Assets and Liabilities and net worth (SALn).
However, it appears, from photos and documents obtained by the Tribune yesterday that Legarda herself has not declared her condominium asset in Manhattan, New York City.
This has led Louis “Barok” Biraogo, a declared public interest advocate that Legarda may be as “guilty” as the impeached Chief Justice in not declaring all of her properties in her SALn.
Biraogo stated emphatically that: “I have all the documentary evidence. I have the smoking gun needed to prove that Legarda does not deserve to stay a minute longer as a senator of the land.”
He stressed that “Legarda should be ashamed to even be campaigning on the same stage as President Aquino under his daang-matuwid (straight path) platform.”
Biraogo claimed that Legarda has been concealing for five years her purchase on May 9, 2006 of a posh condominium unit in New York City. He bared that Legarda had paid in full and in cash the princely price of $700,000 or about P36 million in the exchange rate prevailing in 2006 to acquire the condo unit at #77 Park Avenue, which is a very expensive area in New York where the Rockefellers and Trumps also have properties.

For Legarda to have the ready cash of $700,000 or close to three quarters of a million dollars, it was also asked by others whether she had declared her dollar account in her SALns.
A Youtube video has been making the rounds of her posh condo and the many documents attesting to her ownership of the Manhattan condo, as well as copies of her SALns, where her acquisitions and her total assets failed to reflect either her condominium or her correct total assets.
Even her home in Urdaneta Village was not listed as part of her assets, even when it belongs to her, as she listed this down as a corporation known as Loren Legarda and Associates, where her relatives own one share each while she owns the rest.
Armed with Legarda’s SALns which the senator challenged anyone to secure as they are “public record,” Biraogo pointed out that Legarda hid from public scrutiny the condo unit she bought in 2006 by not declaring it in her SALns covering the years 2007 up to 2010.
“Lo and behold! It was only in her 2011 SALn that Legarda declared for the very first time her ownership of a property in America which she claimed she had acquired for P27,800,000. Let’s not forget that she filed her 2011 SALn at about the time when the impeachment trial of Corona was already at fever pitch,” said Biraogo.

Deathly afraid?
“What made Legarda declare a US property in her 2011 SALN? Was it because she became very, very afraid that she would be in the same boat as Corona – that her hidden condo unit at #77 Park Avenue would be found? Well, as it turns out, she has every reason to be deathly afraid,” said Biraogo.
Whether or not the US property referred to by Legarda in her 2011 SALn is the same as the one at #77 Park Avenue, Biraogo said Legarda, “like Corona before her, is already damaged goods” because the late declaration would not absolve her of what he calls the wrongdoing.
“She should consider withdrawing from the May elections because she will face removal like what happened to Corona. Despite her self-righteous stance during the trial of Corona, Legarda has every reason to be afraid, more afraid now that the truth has finally come out on her US property,” said Biraogo.
“What do we have in Senator Legarda now, a veritable Lady Corona? Well, I suggest she hire a good lawyer because she may be facing plunder raps and multiple counts of money laundering, as well as graft and corruption and perjury charges. She has to explain where she got the money to buy such an expensive property,” said Biraogo.
“Legarda’s declaration of a US property in her 2011 SALn was a pathetic attempt at cover-up because she, as a senator, should know better than most that the SALn law is very specific on the details that a SALn filer must input on the SALn form,” said Biraogo.
“With Legarda leaving blank in the SALn form the details that would have identified the location of that unspecified US property, as well as its current fair market value or if improvements had been done on it, she might as well have not declared it all.”

Huge increases
The pertinent laws governing SALns are strict that public officials must detail all of their assets and liabilities, including the acquisition and fair market value and the addresses of real properties, as well as their investments and bank deposits.
Biraogo noted the huge increase in Legarda’s net worth – from P45,545,565 in 2010 to P68,553,755 in 2011 ; and the big increase in her cash on hand in banks — from P180,000 in 2010 to P7,963,190 in 2011.
He stressed that huge increases in the net worth of public officials, if unsupported by commensurate sources of income, are automatically deemed to be ill-gotten wealth.
“Legarda paid $700,000 in 2006 for the unit at #77 Park Avenue or P35,980,000 at the exchange rate of P51.40-$1 at the time. If that’s the same unit referred to by Legarda in her 2011 SALn, then she undervalued it by claiming the acquisition cost to be just P27,800,000” said Biraogo.
“Using the peso-exchange rate in 2011 instead of the prevailing rate in 2006 may be another clue that Legarda was already frazzled, dazed and confused even, when she declared that acquisition cost of P27,800,000.”
Biraogo said that if Legarda admits that the unit at #77 Park Avenue was what was being referred to in her 2011 SALn, then the harder question for her to answer would be why was the property she bought in 2006 declared only in her 2011 SALn?”
Legarda and the majority of the senators last year ousted Corona from the Supreme Court after finding him guilty of mis- and non-declarations in his SALns of assets, including ownership of several condo units.

Same yardstick
Biraogo said that Legarda should suffer the same fate as Corona, adding that “sauce for the goose should also be sauce for the gander. “
“Senator Legarda should be measured with the same yardstick she used in convicting Corona for being untruthful in his SALn,” said Biraogo, who said he got interested in digging deep into Legarda’s SALn and properties when he learned that their alma mater, the University of the Philippines, would be honoring her as a top alumna.
Biraogo has figured in many national issues and celebrated court cases, starting in his sophomore law student year in UP Diliman when he sued then UP president Edgardo Angara all the way to the Supreme Court for increasing UP’s tuition and other fees by 350 percent.
In 1985, Biraogo challenged before the SC the constitutionality of the snap presidential election which triggered the 1986 People Power Revolt. He also contested in court the customs duties slapped on imported reading materials, pressuring then President Gloria Arroyo into ordering then Finance Secretary Margarito Teves to honor the Philippines’ being a signatory of Florence Treaty forbidding the slapping of customs duties on reading materials.

The Ombudsman has charged Immigration Commissioner Ricardo David with graft for replacing the chief of the agency’s intelligence division despite orders from the Civil Service Commission (CSC) and the Department of Justice to reinstate the latter.
The charge was based on a complaint filed by lawyer Faizal Hussin, who accused David of violating the Anti-Graft and Corrupt Practices Act by failing to reinstate him.
The person who replaced Hussin, lawyer Antonette Bucasas-Mangrobang, was also slapped charges of grave misconduct and usurpation of public functions under the Penal Code. Both charges carry imprisonment and disqualification from holding public office.
The CSC, in its order dated Oct. 25, 2012, affirmed its earlier decision and ordered Justice Secretary Leila de Lima to reinstate Hussin to his original position as chief of the intelligence division of the Bureau of Immigration. Pursuant to the CSC ruling, De Lima had issued a memorandum to the BI dated March 22, 2012, directing David to “immediately implement the said CSC resolution and the department order.”
“Instead of complying with the CSC resolution and the memorandum of Secretary De Lima, Commissioner David, displaying an arrogance rarely seen in public service, issued a memorandum to all the BI personnel clearly stating that Attorney Mangrobang shall continue to be the intelligence chief,” the complaint said.
David assigned Hussin to the Commissioner’s Office and ordered him to seek the prior concurrence of Mangrobang for resources and assistance in the job.
Hussin said David’s act was in stern defiance of the CSC and the justice department’s order.
“If David is allowed to defy orders of the Civil Service Commission and secretary of justice, his immediate superior, nothing will come out of the daang matuwid (straight path) of the President, and others will follow suit,” Hussin said.
