ILLEGAL CHINESE WORKERS

MANILA, Philippines - The Trade Union Congress of the Philippines (TUCP) yesterday called on Congress to investigate the surging number of Chinese and other foreigners allegedly working illegally in the country.
TUCP said the Senate and the House of Representatives must conduct a probe and come up with measures to curb the rising number of foreigners working in the country without government permits because this has adverse implications on local industries and in the employment situation of Filipinos.
Under the law, foreigners seeking employment in the Philippines are required to apply for an Alien Employment Permit.
But last week, the Bureau of Immigration (BI) arrested 50 Chinese, one British and one Australian employed at the construction of a coal-fired plant in Davao City for working without permits, the TUCP reported.
The BI also deported last year more than 200 foreign workers employed at construction sites in Bataan and Batangas provinces, again for working without permits, the labor group added.
“There is indeed a clear, continuing and growing violation of our domestic laws. This further undermines the job security in the country as they compete with the already limited jobs generated for the Filipinos in our homeland,” TUCP spokesman Alan Tanjusay pointed out.
TUCP party-list Rep. Raymond Mendoza earlier filed House Resolution 974, which seeks to conduct an inquiry, in aid of legislation, on illegal foreign workers in the country.
The investigation of Congress, Tanjusay noted, would benefit not only local workers but migrant workers as well, since it would ensure better working conditions for them.
Currently, illegal migrant workers are not covered by the law and therefore vulnerable to violation and exploitation of their basic rights.
Tanjusay also clarified that the TUCP is not against the entry of foreign workers in the country, but of its adverse impact on employment of Filipino workers, who leave the country to work abroad simply because there are no available jobs for them here

It’s not just professionals who ‘doctor’ their taxes

March 6, 2014 10:24 pm A long forgotten government functionary during the Cory years audaciously claimed      that the Philippines was actually a rich country pretending to be poor.
He was not too far off the mark.
If everyone—repeat, everyone—paid the proper taxes, then the government would literally be awash with cash. The country would not have to struggle to exit Third World status. The Philippines would be one of the richest countries in the region.
Unfortunately, tax collection remains one of the weaknesses of the government. Either through loopholes in the Tax Code or via outright tax evasion, corporations and high value individuals are able to underpay or to avoid paying what is due the government.
Recently, the Bureau of Internal Revenue (BIR) took aim at the medical community. On the suspicion that too many physicians do not pay correct taxes, the BIR came out with an advertisement that had the Philippine Medical Association fuming.
“Why single us out?” the PMA asked.

 Why indeed? While it is true that an unknown number of doctors do not pay the right taxes from their professional fees, it is equally true that an equally unknown number of lawyers, accountants, architects, movie stars, chefs, contractors and entrepreneurs also “doctor” their income tax returns year in and year out.
To be blunt about it, even the smallest businessmen such as sari-sari store owners, buy-and-sell traders, taxi drivers, sex industry workers, tourist guides and all sorts of self-employed men and women who do not issue official receipts can be labeled as tax cheats.
Then there are the big businesses.
It is no secret that even Top 1,000 corporations resort to “creative” accounting to minimize, if not avoid, paying the government what is due government.
As an example, it was recently revealed that a small hotel chain had actually paid more in taxes than the biggest chains operating in the country. Surely a small chain grosses far less than the medium-sized ones, and far, far less than the giants.
So what seems to be the problem?
The individuals and corporations which do not pay the full taxes will almost always say that they believe that there is no point in paying what they should: much of it would be lost to graft and corruption anyway.
How many tax evaders, they ask, are locked up in the New Bilibid Prisons?
One estimate places at a breath-taking forty percent the total that is lost to graft and corruption. Think about that for a minute. For every peso paid the government in taxes, forty centavos goes to the pockets and bank accounts of the corrupt.
Oh, there may be small-time government bureaucrats whose lawyers were unable to get them off the hook languishing in prison, but not a single truly Big Fish has been imprisoned for tax evasion. Ever.
In this context, it was not right of the BIR to single out doctors in what amounted to a shame campaign. BIR Commissioner Kim Henares may have had the best intentions, and may have had the support of Malacañang, but surely she knows that the Filipinos who do not pay the proper taxes number in the millions. Singling out a segment of the population is plain and simply unfair.

BI officers at NAIA protest lost overtime pay

MANILA, Philippines - Bureau of Immigration (BI) officers assigned to the Ninoy Aquino International Airport (NAIA) wore yellow armbands yesterday to protest the “unlawful” suspension of their overtime pay.

Senior immigration officer Floro Balato Jr. said Finance Secretary Cesar Purisima, in a July 31 memorandum to President Aquino, recommended discontinuing the practice of customs, immigration and quarantine (CIQ) personnel charging airlines for their overtime pay.
On Aug. 3, Transportation and Communications Secretary Manuel Roxas II wrote the Board of Airline Representatives and the Airline Operators Council, advising them to stop paying overtime to CIQ personnel and report any violation of this policy.
“We wear this yellow arm band to call the attention of President Aquino regarding this matter,” Balato said.
He called on the government to shoulder their overtime pay or “outsource” the function.
Balato said their overtime pay is supported by the Philippine Immigration Act and the Tariff and Customs Code, and discontinuing their payment would only benefit airlines.

The Old Cojuangco Fortune & the First Philippine Republic Funds

ON the first anniversary of the installation of "President" A_NOY Cojuangco Aquino y HOCUS PCOS, let me talk of his family from the maternal side, the Cojuangcos. Let me talk of the controversial history of the where the Cojuangco wealth purportedly came from.

Why the Filipinos should run after the Cojuangco family, the famed family of the late President Corazon Cojuangco-Aquino and her only son, the "incumbent" Malacanang occupant, it is not only the land reform issue of Hacienda Luisita but more so, the first Philippine Republic REVOLUTIONARY FUNDS said to amount to several BILLION pesos.

During the Spanish period, Gen. Antonio Luna, then chief of staff of the revolutionary army, turned over revolutionary funds to his paramour Ysidra Cojuangco for safekeeping.
When Luna was assassinated [apparently upon orders of the fledgling Philippine Republic President Emilio F. Aguinaldo, the Cojuangcos kept the treasure all to themselves — a tradition of treason and greed that has been kept alive by today's Cojuangcos, as well as, their Aquino branch.

Now, Ysidra Cojuangco y Estrella was the eldest child of the Chinese immigrant great grandfather of current Philippine "President" Noynoy Aquino. Jose Cojuangco (I), the lolo of the late ex-President Corazon Cojuangco-Aquino, was the son of a Chinese immigrant from Fujian. His Chinese name was Co Giok Kuan who received the Christian name "Jose." He worked as a carpenter before becoming a building contractor and marrying Spanish meztisa [Antera Estrella]... His children were Ysidra, born 1867; Melicio, born 1871; and Trinidad, born 1876 (Dobbin, pp. 150, 160-161)."

It's not only columnist Tiu-Laurel who is saying that the funds of the First Republic fell into the hands of the Cojuangcos. This has been discussed in the study of another columnist, Larry Henares. Devoting a series to reveal that Gen. Luna left a lovechild by Ysidra Cojuangco--who he concludes to be Antonio Cojuangco III of PLDT fame--Henares also bares how the Cojuangcos suddenly amassed a big fortune, affording their purchase of large tracts of sugar and rice lands.

Bed-ridden but sound of mind, she was irrepressible, regaling us with stories of Dona Ysidra, her neighbor in Sta. Rosa, Nueva Ecija, whom she met when she was 10 years old, and who was going to be her godmother, ninang sa casal, were it not for the distance and difficulty of travel. We recorded her saying that Ysidra admitted that Luna was indeed her very close friend, and that Luna left her valuables, not once but regularly on many occasions. When asked how much value was involved, Encarnacion replied that while she is not sure of the exact value, it was certainly in huge quantities since several huge caskets were involved. Manapat asked her if she knew that there were more than one shipment. She emphatically said yes, the shipments were a regular thing!! Not only was Encarnacion a friend and confidant of Dona Ysidra, she is also the daughter of Eulalio Saulo who confirmed to her the story as one of the military escorts of the gold shipment to Ysidra. As far as we know this is the first direct evidence of a Cojuangco (and Ysidra at that) admitting what many Luna contemporaries long alleged, that the source of the Cojuangco fortune was the gold commandeered by Luna and regularly turned over to Ysidra. The combined assets controlled by the Cojuangcos total about P200 BILLION." (bold supplied)

XXXX "There was an earlier account recounted by historian Carlos Quirino in an unpublished book commissioned by Danding Cojuangco, about a shipment of gold vessels commandeered by General Antonio Luna from churches in Pampanga, collected for him by Tiburcio Hilario, Pampanga governor, brought to Paniqui and entrusted to Ysidra for safekeeping before Luna left for Cabanatuan to meet Aguinaldo, only to be assassinated there. Aha, so gold was brought by Luna from both the Ilocos (through Saulo) and Central Luzon (through Hilario) to Ysidra! With the First Republic on the run and the Americans inquiring about the gold, Ysidra dumped the gold into a well, retrieved it later and used it to build the Cojuangco fortune."

Another person who attests to how the Cojuangcos got hold of the wealth under the care of Gen. Luna as Chief of the Army of the Philippine Republic is author/historian.ex-Ambassador Rafaelita Hilrio Soriano, granddaughter of Pampanga's Revolutionary Governor, Tiburcio Hilario y Tuason. A cousin of the "Great Propagandist" Marcelo H. del Pilar, Gov. Hilario was elected in absentia as military/revolutionary governor of his Pampanga and known as the 'Brains of the Revolution in Pampanga.


Ms. Soriano relates that her grandfather, Gov. Tiburcio, kept the revolutionary treasures in sacks, including gold treasures such as gold plates, chalices, that were commandeered from Bacolor, Guagua, and San Fernando in Pampanga. Jose Cojuangco I received the treasure.

Ms. Soriano : I want to refute the statement that it was believed the money for the revolution did not go to the Cojuangcos. This is a statement of fact. The money, one million silver pesos, was brought by my old grandfather, Tiburcio Hilario, then governor of Pampanga, and given to Antonio Luna. Three days after, Antonio Luna was assassinated. After he was assassinated, where did the money go? The money went to the town where the Cojuangcos lived. Yes, I mean it. It was placed in the package of pacbet on the railroad. Because Luna was already dead, nobody made a claim for the money. They found that the money was with some old clothes. With the baggage and the old clothes, the money was first offered to a Mr. Garcia, Capitan Garcia. He was then the richest man in the town. Knowing where it came from, he refused it. The one who accepted the money was JOSE COJUANGCO [I]. (bold supplied)

The paramour of Gen. Luna did not lead actually lead a quiet or simple life following Aguinaldo's orders to have Luna assassinated. YSIDRA,Ysidra, or Isidra, was "considered one of the richest women in the Philippines in her time, from 1900-1950", helping found the Philippine Bank of Commerce (PBC) in 1938 (Crisostomo, p. 8).

Ysidra was no ordinary woman for she "was charged with life and commercial drive." She dealt not only with rice and sugar but also with gango or small dried shrimps, money lending and more (Pan, p. 153). She helped established the Paniqui Sugar Mills in 1928, producing sugar for domestic as well as export markets, and likewise, alcoholic drinks. In the early 1930s, she and her brothers also partnered with the Jacinto and Rufino families, venturing into stockbroking to establish the Finance and Mining Investments Corp. Later in the same decade, the three families set up the PBC, which was the first bank in the country to be exclusively owned by Filipinos.

Henares continues:

With the death of the father Don Jose, Ysidra the spinster became the head of the family. The Cojuangco family owned some 12,000 hectares, controlled the rice trade of the province and lent so much money to planters and businessmen of Tarlac, Pangasinan and Nueva Ecija that Justice Antonio G. Lucero, the family lawyer thought she practically owned Central Luzon.

Ysidra and the four brothers were determined to make money work for them. They gave out loans to townsfolk for expenses in fiestas, litigation, gambling losses and other reasons, with rice lands as collateral. Many of the borrowers were not able to pay back the loans, so the Cojuangcos’ landholdings expanded by leaps and bounds. By the 1930s, they were considered the biggest land-owning clan in the whole of Central Luzon with tens of thousands of hectares to their name.

Note that Gen. Antonio Luna was assassinated in 1899. Ysidra, according to Isabelo Crisostomo's biography of Cory, became rich in "her time" that began in 1900. Now, where did her money come from? Necessarily woven into this story is the real identity of the child of Ysidra.  Her younger brother, Melicio (or Melencio) Cojuangco, married Tecla Chichioko and fathered four sons: Jose, Juan, Antonio and Eduardo (Pan, p. 154). [The eldest, Jose Cojuangco, Sr., is in turn the father of Cory and Jose "Peping" Cojuangco Jr. The father of Cory and lolo of Noynoy Aquino, Jose Cojuangco Sr., who married Demetria "Metring" Sumulong of Rizal, became a banker, sugar magnate, hacendero and elected Tarlac congressman.]

Antonio Cojuangco, whom Milecio and wife professed to be their child, seems to be the real son of Ysidra. Henares cited a host of evidence, including physical and mental resemblance to the Antonios and differences with the Cojuangcos, the "Antonio" name that has been passed on to PLDT's Tonyboy, the "almost conspiratorial" secrecy of Antonio C.'s birthdate, and the issue of an unnamed body being buried with Antonio C. vis-a-vis the disapperance of Hen. Luna's body. Ayon kay Henares:

A walking distance from the Barasoain Church in No. 540 Paseo del Congreso, the town's main street, stands the old mansion of the Cojuangcos... General Antonio Luna used to sleep there. Aha!

XXX  The other candidate Antonio was born according to his Ateneo 1918 Annual in the year 1899. In that entire Annual all graduates listed ONLY the YEAR of their birth, not the month or the date... all previous and subsequent Annuals, especially those listing the other brothers, gave the EXACT date, month and year of the graduates' birth... the entire 1918 Annual, like his tombstone in Manila Memorial, would be changed to accommodate the secrecy wanted by one single man. As a matter of fact, if Antonio were born in Malolos instead of Paniqui, we will never know, because the Birth Registries in eight volumes, supposedly covering the period from October 1775 to 1904, stops at February 1899 before Antonio might have been born. What is most suspicious is that a tag that describes the missing volume was left inside the exhibit, suggesting that the missing volume actually exists but was stolen.

Arguably, it had been better that the Republic's wealth fell into the Cojuangco's hands instead of the imperialist American's hands. Also, in fairness to Ysidra, she did tried to help the poor by being a philantrophist. As according to Henares, when she died at the age of 93 on July 13, 1960 at the Makati Medical Center, she left IOU's of laborers and the poor that totaled P2 million.

Ysidra used the First Philippine Republic money wisely, letting the treasures earn instead of, well, simply keeping them buried or, worse, spending it. Nevertheless, it's LONG OVERDUE that the nation's money be RETURNED by the COJUANGCOs to where they belong. The Cojuangcos never truly owned the First Republic's treasures and besides, their greed has already borne them much more than they have returned, which brings to mind the rather infamous case of their land-grabbing the Hacienda Luisita way. To return these funds is the moral thing to do. I'm sure that such is what Gen. Luna would have wanted as well, right Tonyboy?

P.S.
If the Cojuangcos ever return the treasures of the First Republic, I'll surely change course and support Noynoy Aquino as "President," no matter his HOCUS PCOS status. Although that seems like wishing for the blue moon further turned yellow....

MANILA, Philippines – Kris Aquino, the controversial youngest sister of President Benigno “Noynoy” Aquino III, is joining politics after the term of her brother expires in 2016.
The Queen of All Media pronounced her plan to run for governor of her home province, Tarlac, before thousands of her town mates Tuesday.
“I feel naman na bilang isang Aquino, whatever political career I hope to have in the future, it has to start in Tarlac,” she said.
Kris, along with her “Dalaw” leading man Diether Ocampo and Pokwang, led the gift giving activity in depressed areas in the province. From Tarlac, they went to 8 barangays in Pasig also to distribute gifts.
She clarified that she is only running in 2016 after Noynoy’s term of office.
Kris said she initially hinted to her ABS-CBN bosses about her political plans in 2013, but was reminded that her contract obligations with the network will expire in 2015.
She said she wants to follow in the footsteps of Batangas Gov. Vilma Santos.

She said: “Hindi ko nakakalimutan ‘yong sinabi ng mom ko na if there is anybody in showbiz na I should be emulating its Ate Vi ‘yon. Kasi pagkatapos ng napakagandang karera niya sa industriya natin, nakapagbigay naman siya ng magandang serbisyo. Una sa Lipa (as mayor) and then after sa Batangas.”
Meanwhile, Kris was asked to comment on model-actress Isabel Oli denying any romantic relationship with her estranged husband, James Yap.

There appears to be a consensus among analysts and observers of the Sabah dispute after followers of Sulu Sultan Jamalul Kiram III occupied a village called Lahad Datu in Sabah and after some have died in firefight.  The Aquino administration indeed committed a series of blunders.
Let’s rewind a bit. The sultan felt snubbed in the signing of the Bangsamoro Framework Agreement, which the administration touted as the key to achieving peace in Mindanao.  In fact the Sultan claimed he had sent not one but three letters to Malacañang where he expressed his desire to be consulted on the peace issue. President Aquino said the letters must have been lost in the bureaucratic maze.
What a lame excuse. Executive Secretary Paquito Ochoa serves as some kind of a Grand Central Station where all letters to the President pass through. Palace insiders however say that Ochoa indeed received the letters but he passed them through Presidential Adviser on the Peace Process Teresita Deles.  I cannot confirm this, but I am told that Deles decided not to let the President know about it.  She kept the letter, believing it would have no impact on the peace process.
Mr. Aquino reportedly berated Deles when he learned about what happened.  A bureaucrat with delicadeza would have resigned – Deles obviously does not have it.
Thus the Sultan, perhaps thinking that it occupying a village in Sabah is the only way for the government to acknowledge its rights, decided to send 200 of his followers to the disputed territory. There are 800,000 Filipino Muslims who have, legally or otherwise, made Sabah their home.
Instead of being sensitive to the Sultan’s claim and to the plight of Filipinos in Sabah who were being threatened by Malaysian police, President Aquino went on television, flanked by Justice Secretary Leila de Lima and Interior and Local Government Secretary Mar Roxas, warning Kiram that he and his men could face charges for constitutional violations. He told them to come home.
But the Sultan says Sabah is home.
Don’t threaten Tausogs with arrest or criminal charges.  They are very proud, like Maguindanaoans and Maranaws.
The stance taken by Malacañang made it look like it was siding with Malaysia.
Who are advising President Aquino? It looks like he was not aware of the implications of events. Analysts say the issue is not just legal.
What is the bottom line of the dispute? Historic and documentary evidence of ownership by the Sulu Sultanate over Sabah is clear and unmistakable. This is why Malaysia refuses to bring the matter to the International Court of Justice, or the United Nations.
In 1704, the Sultan of Brunei sought support from the Sultan of Sulu to quell a rebellion in Brunei. In gratitude, the Sultan of Brunei gave North Borneo, as Sabah was called then, to the Sultan of Sulu. In 1874 or 174 years later, Baron Von de Overbeck leased North Borneo from the Sultan of  Sulu for 5,300 Mexican pieces of gold a year. Overbeck created the British North Borneo Co., a chartered company by Great Britain. After the death of Sultan Jamalul Kiram in 1936, the British company stopped the leased payments, but a Session Court in North Borneo ordered resumption of payment.
When North Borneo was renamed Sabah, despite objections of the Philippine government, Sabah became part of the Federation of Malaysia.
When the Federation of Malaysia was created in 1963, Malaysia converted the stipulated rental payment into Malaysian ringgit (now equivalent to P77,000) but not the equivalent of 5,300 pieces of Mexican gold. And this is where the core of the dispute lies. The lease agreement used the word “padjak.” After 85 years of paying rent to the Sultanate of Sulu since 1878, Malaysia in 1963 conveniently misinterpreted the word “padjak” to mean cession or sale. The Sulu Sultanate insists “padjak” means rent, and that it is not a sale.  And why does Malaysia continue to pay rent to the Sulu Sultanate? Malaysia’s position is untenable.
As a lawyer, I  know that a sale needs a specific price. Thus, the continuous indefinite annual payment of P77,000 by Malaysia to the Sultanate cannot by any stretch of the imagination be a definite sale by any legal definition.
This leads me to ask: Didn’t the legal advisers of President Aquino ever consider the legal implications of the Sabah claims? Obviously not since that would rock the boat in our political and economic relations with Malaysia, especially now that Malaysia is brokering the Bangsamoro Framework Agreement.
What is clear is that President Aquino deemed our relations with Malaysia more important than the Sultanate of Sulu.
The President threatened to arrest and charge Kiram and his followers. That does not make sense. Why didn’t Malacañang organize a special task force to attend to the dispute? Who appears anti-Filipino now?
I have been told that even Christians in Mindanao are sympathizing with the Sultanate of Sulu.
“Honor is above life,” the Sultan said. I hope I am wrong on this, but I fear this will have a negative impact on the peace process in Mindanao and our relations with Malaysia.

The Aquino administration has outdone itself this time.
After displaying utter unpreparedness and ineptitude in handling a crisis in sovereignty and foreign relations, the chief executive now says certain “persons of interest” funded and directed the acts of the Sulu sultan whose men sailed to Sabah and occupied a village there three weeks ago.
Things turned for the worse over the weekend when more than a dozen were killed in gunfight in Lahad Datu and nearby places.  Most of the casualties belonged to the camp of the Sulu Sultan Jamalul Kiram III.
In Monday’s press conference held in Malacañang, President Benigno Aquino III referred to intelligence reports that the Sultan of Sulu and his followers were acting in concert with other forces – specifically those on the side of his predecessor — that wanted to sabotage the government’s peace talks with the Moro Islamic Liberation Front.
He also made no secret of his desire to remain in the good graces of our neighbor Malaysia.  Imagine we were in the opposite situation and a group of armed men arrived and occupied a place we administered, Mr. Aquino said. How are we supposed to act when these men point guns to our faces?
Small wonder he offered no sober words to the sultan, who banks on history and a lease agreement besides to boost his – actually, our — claim on Sabah.   Instead, after taking too long to act on or even speak about the Sabah standoff, Mr. Aquino warned the sultan that he and his men could face charges for their acts and blamed them for endangering the peace talks with the Moro Islamic Liberation Front. Malaysia acts as facilitator  for these talks.
To be sure, the President is not oblivious to the criticism he has been receiving on his inept handling of the Sabah issue, even way before the shooting that began Friday. Now he has found a good excuse to ties these together: “The concerted criticism points to a conspiracy,” he said.
And just like that, the President has succeeded in oversimplifying the issue and reducing the complex matter into an us-or-them situation.
Mr. Aquino’s outrageous claims have caused a stir and will likely elicit a firestorm of protest and demand for proof. Tragically, this will come at the expense of the 800,000 Filipinos in Sabah, the sultan’s supporters, the families of those who were killed in the standoff, the people of Mindanao and all Filipinos who need our leader to simply know how to handle tense episodes instead of bungling like an idiot and blaming everybody except himself.
