Most of us have been working with the government for more than 15 years and this is the first time, under the Aquino Administration, under DAANG MATUWID,  that that we felt SO MUCH ABUSED. Our Civil Service Rights have not been respected due to the various conflicting memorandum orders being issued by the capricious appointees of PNOY from highest levels down to the lowest agencies. With the apparent loss of our seniority rights also come with the withdrawal of our allowances, mandatory bonuses and hazardous pays. Inspite of our best efforts to assist PNOY in his so called DAANG MATUWID PROGRAM," we feel we are being treated like dirt. We are being made to feel that we OWE Aquino our appointments and our salaries, not having considered the fact by these SECRETARIES, USECS, COMMISSIONERS and BUREAU CHIEFS, that many of us were already working in the government before them.

BI officers at NAIA protest lost overtime pay




MANILA, Philippines - Bureau of Immigration (BI) officers assigned to the Ninoy Aquino International Airport (NAIA) wore yellow armbands yesterday to protest the “unlawful” suspension of their overtime pay.
Senior immigration officer Floro Balato Jr. said Finance Secretary Cesar Purisima, in a July 31 memorandum to President Aquino, recommended discontinuing the practice of customs, immigration and quarantine (CIQ) personnel charging airlines for their overtime pay.
On Aug. 3, Transportation and Communications Secretary Manuel Roxas II wrote the Board of Airline Representatives and the Airline Operators Council, advising them to stop paying overtime to CIQ personnel and report any violation of this policy.
“We wear this yellow arm band to call the attention of President Aquino regarding this matter,” Balato said.
He called on the government to shoulder their overtime pay or “outsource” the function.
Balato said their overtime pay is supported by the Philippine Immigration Act and the Tariff and Customs Code, and discontinuing their payment would only benefit airlines.

Customs employees oppose return-to-mother-unit order

MANILA, Philippines – Bureau of Customs (BOC) employees are strongly opposing an order crafted by the Department of Finance's newly formalized Revenue Cluster ordering them to return to their mother units.
In a statement, the BOC Employees Association (BOCEA) said the order will result in "massive dislocation, displacement and abandonment of functions" that may paralyze BOC operations.
"Such order caused restiveness and anxiety among the rank-and-file employees of the Bureau of Customs who are all in a quandary why did the Commissioner of Customs is again turning the guns on the lowly rank-and-file employees," said the group.
The Revenue Cluster headed by Bureau of Internal Revenue (BIR) Commissioner Kim Henares issued Customs Personnel Order (CPO) B-134-2013, mandating all BOC employees to return to their mother units, effectively revoking their current assignments. The cluster covers the BIR, BOC and the Bureau of Local Government Finance. The order was signed by BOC Commissioner Ruffy Biazon and approved by DOF Secretary Cesar Purisima.
BOCEA said Biazon is "ill-advised."
"This will gravely affect the security of tenure, basic rights of the employees under the Constitution and the welfare and interest of the whole rank-and-file employees," it said.
Henares said the order is just the first in a series of reforms that the Revenue Cluster will implement at the BOC, which President Benigno Aquino III singled out in his 4th State of the Nation Address for rampant corruption.
She maintained it is meant to put things at the agency in order. She said employees should be at their "plantilla" posts or where they were originally appointed.
The first batch of employees affected by the CPO included Supervising Customs Operating Officers and Customs Operations Officers III. These officers were relieved of their assignments on September 13, Biazon said in the CPO.
The second batch covered all Chief Customs Operations Officers and Customs Operations Officers V, whose designations were revoked on September 15.
“All officials and employees who are affected by the CPO have 10 days to report to their permanent units. By September 27, 2013, all employees of the BOC should be back at their respective permanent positions,” Biazon said.
"Failure to report to original/permanent units on or before the designated deadline may be grounds for administrative sanctions," he added.
No plantilla posts?
As expected, there are difficulties in implementing the order.
In a September 13 memorandum to Biazon, BOC Director for Administration Ma. Corazon Azana listed down several units and offices that do not have plantilla positions and hence will be left with no manpower.
Some Customs offices and ports have plantilla positions, but these are already inactive, Azana also said. "Recalled personnel have no office or port to report to."
These offices include BOC's Water Patrol Division, Radio Communication Division, Subport of Tabaco, Subport of Jose and the Food Terminal Inc. Customhouse.

Henares stressed that the CPO was a product of joint efforts to reform the BOC.
“It’s a joint effort of DOF and Customs,” she said.
The Revenue Cluster vowed to carry out sustainable reforms to institutionalize integrity in the BOC, curb smuggling, and plug tax leaks.
A Finance official said there will be "second and third waves" after the issuance of the CPO.
The official said among the changes planned is the transfer of some ranking Customs official to the DOF.
The biggest task at hand however is modernizing Customs procedures, said Biazon.
Changes at the BOC have the blessing of President Aquino. "All of these have clearance from the President," said Henares. – Rappler.com

Smoking Gun’ Memo Proves Pope Francis Collaborated with Military Junta

Allegations that Jorge Bergoglio, now Pope Francis I, collaborated with Argentina’s brutal military dictatorship have been circulating for decades. The Pope, and the Vatican he now heads, have vehemently denied these allegations.
The Vatican has dismissed the allegations against the new Pope as a “left-wing anti-clerical attack on the church.” Vatican spokesman Father Federico Lombardi insisted there has never been a “concrete or credible accusation” against Bergoglio. On Sunday, an Argentinian newspaper published a government memo that seems to definitively prove that Bergoglio did indeed provide information to the murderous dictatorship, informing authorities about allegations against two Jesuit priests who were kidnapped, tortured and imprisoned for five months for allegedly contacting anti-regime leftist guerrillas.
Furthermore, Gregoglio is alleged to have sold the priests out even while he personally promised them his protection. On March 13, Digital Journal published a lengthy article detailing Jorge Bergoglio’s– and the Argentine Catholic church’s– alleged role in collaborating with that country’s brutal, US-backed military dictatorship, a regime characterized by kidnapping, torture, murder and disappearance. As many as 30,000 people, from students, trade unionists, journalists and leftists and their sympathizers to children and even pregnant women (whose babies were stolen), were killed or disappeared during the 1976-1983 ‘Dirty War,’ which was fully supported by the Carter and Reagan administrations.
Many of the most brutal regime figures, including the dictator Gen. Leopoldo Galtieri, were trained by the US military in kidnapping, torture, assassination and democracy suppression. Clergy who were critical of the regime, or who associated with groups deemed enemies, were targeted for imprisonment, torture and sometimes assassination. Conversely, other priests enthusiastically collaborated with the perpetrators of horrific abuses. Father Christian von Wernich, a former police chaplain, was sentenced to life in prison for his involvement in dozens of cases of kidnapping, torture and murder during those dark years. It has been alleged in a lawsuit that Jorge Bergoglio, who was the leader of Argentina’s Jesuit order at the time of the military dictatorship, was involved in the kidnapping of two of his fellow Jesuit priests, Orlando Yorio and Francisco Jalics, who were working to help the slum-dwelling poor, some of whom were linked to leftist rebels.
The priests were imprisoned by the navy, tortured and held for five months before being dumped half-naked and drugged in a field. The new Pope claims he intervened on their behalf to secure their eventual release, saving their lives. This may very well be true, although there is no documented proof of it. Yorio, who died in 2000, accused Bergoglio of “effectively handing [the priests] over to death squads.” “I am sure that he himself gave over the list with our names to the navy,” Yorio said at a 1985 trial of military junta leaders. As for Bergoglio’s claim that he saved the priests’ lives, Father Yorio flatly denied this. “I do not have any reason to think he did anything for our release, but much to the contrary” the priest told Horacio Verbitskty, one of Argentina’s most respected investigative journalists. Yorio said Bergoglio had expelled him from his post at a Jesuit school and spread false rumors that “I was a communist, a subversive guerrilla who was after women, rumors that immediately came to the attention” of the regime’s dreaded security forces. As for Jalics, he seems to have made his peacewith Bergoglio and now says he is “unable to comment on the role” of the new Pope in his ordeal. “I am reconciled and on my part, consider the matter to be closed,” he recently said. Forgiveness is a central tenet of Christianity. But in an earlier book, Jalics wrote that, “from subsequent statements by an official and 30 documents that I was able to access later, we were able to prove, without any room for doubt, that this man did not keep his promise [to protect the priests], but on the contrary, he presented a false denunciation to the military.”

This government memo seems to be the ‘smoking gun’ proving that Pope Francis I indeed collaborated with the ‘Dirty War’ regime.
Indeed, the Argentinian newspaper Página 12 has reprinted a foreign ministry memo from 1979 that specifically mentions Bergoglio providing information about the earlier allegations against Jalics and Yorio, which include having contact with guerrillas and fomenting dissent among nuns.

A foreign ministry official noted that “this information was provided… by Father Bergoglio.” In his book, El Silencio (The Silence), Verbitsky also exposes Bergoglio’s attempt to cover up his fealty to the murderous regime by expunging incriminating passages from a book he wrote detailing a 1976 meeting between Church leaders and the ruling junta. Deleted was a vow that the Church “in no way intends to take a critical position toward the action of the government,” as well as a declaration of the Church’s “understanding, adherence and acceptance” of the regime’s policies. Indeed, during the dictatorship, priests offered communion and God’s forgiveness to torturers and murderers, with priests allegedly giving at least tacit blessing to ‘death flights’– by which drugged and tortured regime victims were dumped into the sea from airplanes– as “a Christian form of death.”
Verbitsky also accuses Bergoglio of hiding dozens of political prisoners from a visiting delegation of international monitors from the Inter-American Human Rights Commission. Yet another accusation leveled against Bergoglio is that he failed to adequately help a family who lost five members to the junta’s murderers. Five members of the de la Cuadra family, including a pregnant woman, were killed after appealing to the Jesuit leadership in Rome for protection. The Jesuits then reportedly turned to Bergoglio, who assigned a subordinate to the case.
The subordinate reportedly returned to Bergoglio with a letter from a colonel informing that the pregnant woman, who in keeping with the regime’s twisted notions of Christianity had been kept alive long enough to give birth, was dead and that her baby had been given to a family “too important” to remove it from. Pope Francis claims he had no knowledge of stolen babies, of which there hundreds, if not thousands, until after the end of the dictatorship. He claims to have “did what [he] could with the age and the little influence [he] had” to save people from the regime. According to an Argentinian human rights group established to locate babies stolen during the ‘Dirty War’ period, Pope Francis did not do nearly enough to help victims. “Bergoglio has a very cowardly attitude when it comes to something so terrible as the theft of babies,” Estela de la Cuadra, daughter of Grandmothers of the Plaza of Mayo founder Alicia de la Cuadra, told the Associated Press. “He has never spoken of the problem of people who had disappeared under dictatorial rule, and 30 years have already passed since our return to democracy,”
Grandmothers of the Plaza of Mayo president Estela Carlotto, whose pregnant daughter Laura was abducted, tortured and murdered by regime forces, told Agence France-Presse. Laura’s son has never been found. “I am a Catholic, and many of us sought help from the Church in the first years of the dictatorship because we believed that bishops were on our side,” Carlotto added with disappointment. But as the regime’s own documents now seem to prove, not only did Bergoglio fail to help those in life-or-death situations, the new Pope actively collaborated with those who kidnapped, tortured and murdered thousands of men, women and children. Critics claim the Vatican also shares the blame. Global Research reports that the Vatican supported the collaboration between the Argentinian Catholic Church and the dictatorship during the ‘Dirty War.’ In 1981, another new pope, John Paul II, traveled to Buenos Aires in a show of support with the junta, kissing Gen. Galtieri and uttering not a word about the tens of thousands of Argentinians who’d been kidnapped, tortured, murdered and disappeared.

President Aquino and his pork

PRESIDENT Benigno Simeon Aquino III had to resort to smooth talking in an apparent bid to make it appear to his “bosses” that he is acquiescing to their wishes to abolish the pork barrel system. But is he really abolishing the pork barrel which is officially known as the Priority Development Assistance Fund? Let us see.
In a televised speech three days before the historic Aug. 26 People’s Cry against the Pork Barrel in Luneta, B.S. Aquino declared the abolition of PDAF but justified its existence, a clear indication that he finds nothing wrong in it. He said pork barrel enables lawmakers to identify and finance projects that cannot be afforded by local government units.
“Wala pong mali o masama sa polisiyang ito. Ang mali, ang masama, at ang siya ngang ikinagagalit ng taumbayan, ay ang pagsasabwatan sa pagitan ng isang pangulong handang makipagtransaksyon para manatili sa kapangyarihan; mga mambabatas handang makipagkuntsabahan; at kung nariyan ang kooperasyon ng burukrasya; at mga mamamayang tila namanhid na sa panlalapastangang ginagawa sa kanila–kung nagsama-sama po ang mga sangkap na ito, maaaring maabuso ang PDAF. Kailangan nating maniguradong hindi na maaabuso ang sistema,” Aquino stressed.
The practice of doling out pork to lawmakers resumed in 1990 during the administration of B.S. Aquino’s late mother former President Corazon Aquino after an 18-year hiatus throughout the dictatorial regime of Ferdinand Marcos. At the time it was called Countrywide Development Fund.
At the same time, B.S. Aquino revealed that he already directed the Department of Budget Management to take the appropriate steps that would prevent abuses in PDAF spending. “Inatas po nating itala sa Pambansang Budget kung magkano ang PDAF na natatanggap ng bawat mambabatas, at ipinagbawal na rin natin ang congressional insertions. Partikular na lamang ang menu na puwedeng paglagyan ng PDAF, hindi katulad dati kung kailan inilalagay lamang ito sa kung saan-saan. Hinihingi na rin natin ang mga detalye ng proyekto, di gaya ng nakaraan kung kailan kahit malawak ang depinisyon ay naaaprubahan ito…”
However, as B.S. Aquino abolished the PDAF he immediately categorized the now nameless fund as budget for line item projects of lawmakers. He explained that line budgeting is the mechanism that would ensure that the people’s money is not corrupted by unscrupulous politicians and individuals. The executive department will still finance the lawmakers’ pet projects but with a catch. From now own the lawmakers’ projects will be subject to closer scrutiny for “accountability purposes.”

What B.S. Aquino did not really say is that pork is the “grease” that makes the cogs of Congress run smoothly for him and all other previous occupants of Malacanang. Without this fat, Congress won’t be under the beck and call of the President. Pork is the incentive (or should I say bribe?) that motivates lawmakers to toe the President’s line. This is really why pork cannot be abolished.
So in effect what the President did when he talked about abolishing the PDAF was he took with his left hand what he gave with his right. B.S. Aquino just tightened his grip on the members of Congress. The members of Congress would now be easier to control.

There are some who are of the opinion that the removal of Renato Corona from the Judiciary as its chief is part of his grand design to control that institution and it served as a prelude to his plan to control the legislature. I did not believe that then but I am now having some doubts.
With one press statement announcing tighter controls for the much hated pork barrel funds, B.S. Aquino recently managed to tighten his hold on Congress without looking bad in public. This “decisive” act was the final straw to bring the three separate co-equal institutions of government – executive, legislative and judiciary – under B.S. Aquino’s influence. Now the tenant in Malacanang has a “say” in every government institution in the country.
Now it is evident that except for Marcos and perhaps his teacher Gloria Macapagal-Arroyo, B.S. Aquino, through wily political maneuverings and sheer luck, now exerts more governmental power than any other past president. It seems that the only remaining institutions that have not completely fallen under his sway are the press and the church.

Janet Napoles finally went to Malacanang and surrendered to B.S. Aquino after the government placed a P10-million bounty on her head. Not only did the President graciously accept Napoles’ surrender, he even accompanied her to Camp Crame without suffering the inconvenience of a handcuff.
Well, well, well. I remember that B.S. Aquino refused to meet Jamalul Kiram III, the Sultan of Sulu, when he tried to meet him in a bid to resolve the Sabah controversy. Kiram’s only fault was that he tried to reclaim Sabah for the Philippines.
If what Napoles, who is accused of illegal detention and is said to be behind the multi-billion peso pork barrel scandal that only apparently benefits the corrupt politicians, received is not special treatment, then I do not know what it is. Perhaps that is the regular order of the day.

Re-electionist Sen. Loren Legarda was one of 20 senators who had voted to convict impeached Chief Justice Renato Corona for not declaring his dollar accounts as well as his properties where he failed to state the acquisition cost in his Statement of Assets and Liabilities and net worth (SALn).
However, it appears, from photos and documents obtained by the Tribune yesterday that Legarda herself has not declared her condominium asset in Manhattan, New York City.
This has led Louis “Barok” Biraogo, a declared public interest advocate that Legarda may be as “guilty” as the impeached Chief Justice in not declaring all of her properties in her SALn.
Biraogo stated emphatically that: “I have all the documentary evidence. I have the smoking gun needed to prove that Legarda does not deserve to stay a minute longer as a senator of the land.”
He stressed that “Legarda should be ashamed to even be campaigning on the same stage as President Aquino under his daang-matuwid (straight path) platform.”
Biraogo claimed that Legarda has been concealing for five years her purchase on May 9, 2006 of a posh condominium unit in New York City. He bared that Legarda had paid in full and in cash the princely price of $700,000 or about P36 million in the exchange rate prevailing in 2006 to acquire the condo unit at #77 Park Avenue, which is a very expensive area in New York where the Rockefellers and Trumps also have properties.

For Legarda to have the ready cash of $700,000 or close to three quarters of a million dollars, it was also asked by others whether she had declared her dollar account in her SALns.
A Youtube video has been making the rounds of her posh condo and the many documents attesting to her ownership of the Manhattan condo, as well as copies of her SALns, where her acquisitions and her total assets failed to reflect either her condominium or her correct total assets.
Even her home in Urdaneta Village was not listed as part of her assets, even when it belongs to her, as she listed this down as a corporation known as Loren Legarda and Associates, where her relatives own one share each while she owns the rest.
Armed with Legarda’s SALns which the senator challenged anyone to secure as they are “public record,” Biraogo pointed out that Legarda hid from public scrutiny the condo unit she bought in 2006 by not declaring it in her SALns covering the years 2007 up to 2010.
“Lo and behold! It was only in her 2011 SALn that Legarda declared for the very first time her ownership of a property in America which she claimed she had acquired for P27,800,000. Let’s not forget that she filed her 2011 SALn at about the time when the impeachment trial of Corona was already at fever pitch,” said Biraogo.

Deathly afraid?
“What made Legarda declare a US property in her 2011 SALN? Was it because she became very, very afraid that she would be in the same boat as Corona – that her hidden condo unit at #77 Park Avenue would be found? Well, as it turns out, she has every reason to be deathly afraid,” said Biraogo.
Whether or not the US property referred to by Legarda in her 2011 SALn is the same as the one at #77 Park Avenue, Biraogo said Legarda, “like Corona before her, is already damaged goods” because the late declaration would not absolve her of what he calls the wrongdoing.
“She should consider withdrawing from the May elections because she will face removal like what happened to Corona. Despite her self-righteous stance during the trial of Corona, Legarda has every reason to be afraid, more afraid now that the truth has finally come out on her US property,” said Biraogo.
“What do we have in Senator Legarda now, a veritable Lady Corona? Well, I suggest she hire a good lawyer because she may be facing plunder raps and multiple counts of money laundering, as well as graft and corruption and perjury charges. She has to explain where she got the money to buy such an expensive property,” said Biraogo.
“Legarda’s declaration of a US property in her 2011 SALn was a pathetic attempt at cover-up because she, as a senator, should know better than most that the SALn law is very specific on the details that a SALn filer must input on the SALn form,” said Biraogo.
“With Legarda leaving blank in the SALn form the details that would have identified the location of that unspecified US property, as well as its current fair market value or if improvements had been done on it, she might as well have not declared it all.”

Huge increases
The pertinent laws governing SALns are strict that public officials must detail all of their assets and liabilities, including the acquisition and fair market value and the addresses of real properties, as well as their investments and bank deposits.
Biraogo noted the huge increase in Legarda’s net worth – from P45,545,565 in 2010 to P68,553,755 in 2011 ; and the big increase in her cash on hand in banks — from P180,000 in 2010 to P7,963,190 in 2011.
He stressed that huge increases in the net worth of public officials, if unsupported by commensurate sources of income, are automatically deemed to be ill-gotten wealth.
“Legarda paid $700,000 in 2006 for the unit at #77 Park Avenue or P35,980,000 at the exchange rate of P51.40-$1 at the time. If that’s the same unit referred to by Legarda in her 2011 SALn, then she undervalued it by claiming the acquisition cost to be just P27,800,000” said Biraogo.
“Using the peso-exchange rate in 2011 instead of the prevailing rate in 2006 may be another clue that Legarda was already frazzled, dazed and confused even, when she declared that acquisition cost of P27,800,000.”
Biraogo said that if Legarda admits that the unit at #77 Park Avenue was what was being referred to in her 2011 SALn, then the harder question for her to answer would be why was the property she bought in 2006 declared only in her 2011 SALn?”
Legarda and the majority of the senators last year ousted Corona from the Supreme Court after finding him guilty of mis- and non-declarations in his SALns of assets, including ownership of several condo units.

Same yardstick
Biraogo said that Legarda should suffer the same fate as Corona, adding that “sauce for the goose should also be sauce for the gander. “
“Senator Legarda should be measured with the same yardstick she used in convicting Corona for being untruthful in his SALn,” said Biraogo, who said he got interested in digging deep into Legarda’s SALn and properties when he learned that their alma mater, the University of the Philippines, would be honoring her as a top alumna.
Biraogo has figured in many national issues and celebrated court cases, starting in his sophomore law student year in UP Diliman when he sued then UP president Edgardo Angara all the way to the Supreme Court for increasing UP’s tuition and other fees by 350 percent.
In 1985, Biraogo challenged before the SC the constitutionality of the snap presidential election which triggered the 1986 People Power Revolt. He also contested in court the customs duties slapped on imported reading materials, pressuring then President Gloria Arroyo into ordering then Finance Secretary Margarito Teves to honor the Philippines’ being a signatory of Florence Treaty forbidding the slapping of customs duties on reading materials.
