3 ex-Customs execs eye Biazon’s post

Two former deputy commissioners of the Bureau of Customs and a congressman from Mindoro are allegedly jockeying to replace beleaguered Customs Commissioner Rufino Biazon who has come under fire for rampant smuggling and the agency’s repeated failure to meet collection targets.
The Customs official, who asked not to be identified for fear he might be suspected of being interested in a higher position, identified the former Customs officials are deputy commissioner Horacio Suansing and deputy commissioner Peter Manzano.
Aside from the two deputy commissioners, the source said Mindoro Oriental Rep. Reynaldo Umali, who was also a deputy commissioner before he entered politics, is also supposedly interested in replacing Biazon.
Umali was one of the House prosecutors in the impeachment trial of ousted Supreme Court Justice Renato Corona while Suansing is a nephew of Senator Miriam Defensor Santiago. Manzano, on the other hand, is associated with Executive Secretary Paquito Ochoa.
“The people close to Deputy Commissioner Manzano are now looking for more allies in Malacanang for him to be appointed and take over the post, while supporters of Dep. Com. Suansing are seeking recommendation from Liberal Party officials, especially its president (Local Government Secretary) Mar Roxas,” the source said.
On Friday, ABS-CBN News reported that Biazon named former deputy commissioner Gallant Soriano as being behind the demolition job against him, but Soriano denied seeking Biazon’s ouster.
The source made the revelation shortly after Malacañang spokeswoman Abigail Valte said in an interview with a government radio station that the Palace is indeed considering an option to privatize the Bureau of Customs, but the matter was still in the initial stages of discussion.
“From what I understand from [the] commissioner, that is one of the suggestions [but] the discussions are initial,” Valte said on dzRB radio.
Valte’s made the remark three days after President Aquino himself said on Wednesday that the administration is planning to implement an unspecified plan to purge of the bureau of corrupt officials.
The Chief Execurtive did not specify plans but he said Biazon was aware of the plans and the Palace was only considering the timing of the action.
“Just wait for the long-planned solution so that we can ensure that all Customs officials are not corrupt,” Aquino said during the groundbreaking of the Roxas Airport Development Project in Roxas City in Capiz on Wednesday.
Last month, Biazon himself told members of the Makati Business Club, Management Association of the Philippines and the European Chamber of Commerce of the Philippines that the administration was crafting plans to abolish the BoC as a government agency and privatize it.
The idea to privatize the Customs burea, as well as the Bureau of Internal Revenue, was first suggested by the World Bank and International Monetary Fund when the Philippines was beginning its exit program from the IMF during the administration of former President Joseph Estrada.

Noynoy allies reaping gains from ‘power crisis’

The Aboitiz and Alcantare families are long allies of the family of President Aquino. The state firm National Power Corp.’s (Napocor) president was Ernesto Aboitiz during the term of President Cory Aquino, the incumbent’s mother. Cory Aquino abolished the Ministry of Energy (MoE) on the mere reason that it was first created by former President Ferdinand Marcos, making Napocor then the policy-making agency of the government.
That was when 12-hour daily brownouts hit Luzon as a result of the failure of Cory Aquino’s to plan ahead in terms of power supply.
At least 15 distribution utilities and cooperatives in Mindanao have signed contract with AboitizPower to obtain power from its coal-fired power plant.
The Mindanao utility firms have contracted 180 megawatts or more than 50 percent of the total capacity of Aboitiz unit Therma South Inc.’s (TSI) 300 megawatt (MW) coal-fired power plant now being constructed in Toril, Davao City. TSI’s coal plant will go online in mid-2015.
“These contracts have been submitted to the Energy Regulatory Commission for review. And we are awaiting the ERC’s decision,” an AboitizPower official said.
The Cotabato Electric Cooperative (Cotelco) which covers six towns in North Cotabato, has also signed an energy supply agreement with Therma South Inc. Under the contract, the Cotelco P-Palma Area will purchase 5MW of power from the 300-MW circulating-fluidized bed coal plant in Toril district.
Also among distribution utilities that contracted power from TSI’s coal plant are AboitizPower subsidiaries Davao Light and Power Co., and Cotabato Light and Power Co.
Electric cooperatives Surigao del Sur, Electric Cooperative II, Misamis Occidental 1 Electric Cooperative, Cotabato Electric Cooperative and Sultan Kudarat Electric Cooperative, the PNA learned.
Hedcor Sibulan Inc. (HSI), which is also an Aboitiz unit, got approval for government incentives for the Tudaya 1 Hydroelectric Power Plant in Sta. Cruz, Davao del Sur.
This is the third hydro plant of HSI after Sibulan Plant A and Plant B which produces a combined capacity of 42.5 MW.
During the 16th annual Mindanao Business Conference held at KCC Mall Gensan, Alsons Consolidated Resources president Tomas Alcantara also announced they were going to build a coal-fired power plant with a capacity reaching up to 900MW in Sarangani to meet projected increase in demand for power supply and in anticipation then to the projectedpower crisis that will hit the island by 2011 — when supply will no longer be adequate to meet demand in Mindanao.
Most electric cooperatives then were also gearing up and anticipating the full privatization of all remaining assets of Napocor, including the sale of the Agus and Pulangi hydroelectric plants.
Socoteco 2’s contract with Napocor expired in 2011. Napocor had earlier sold two power barges moored in Mindanao, Power barge 117 and 118, which have a combined capacity of 100MW and decommissioned its 56MW diesel plant in General Santos.
In 2009, Socoteco announced it is opening bid for the supply of additional capacity in anticipation to increase in local demand for power.
Unfortunately, there were only two bidders at the time which, under its charter and ERC rules, resulted in failed bidding.
The bidders then were only Agus 3 and Conal Holdings Corporation, the power holdings company of Alsons Consolidated Resources.
Both offered to supply base load capacity for indicative projects. Agus 3 is an erstwhile hydroelectric power plant project of Napocor but was mothballed as it required inundating villages for the construction of a dam.
A group of private investors is now pursuing the project, the application of which was referred to Power Sector Assets and Liabilities Management Corp. (Psalm). Psalm manages all remaining generating assets of Napocor as mandated by the Electric Power Industry Reform Act (Epira) or RA 9136.
President Aquino, meanwhile, reiterated his position that the power crisis in Mindanao has been undergoing study while stressing that the power problem would be resolved when the power plants of his allies go online in 2015.
The pestering power crisis in Mindanao was attributed to the decreased in generating capacity of hydropower plants caused by the reduced water level in Lake Lanao.
Based on the Philippine Development Energy Plan 2012-2030, the Mindanao grid will need an additional capacity of 2,188 MW by 2030.
“The initial plan is to fix the mechanism. By 2015, those coal power plants would be online, for instance, the Aboitiz. But 2013 up to 2015, we will put up diesel power plants that will generate power,” Aquino said.
Aquino said that the temporary use of diesel power plants has been considered to be an alternative to remedy the present situation in Mindanao power problem.
“The problem on diesel is expensive. But this is only interim. After we have used this in the entire Mindanao, the power would then be transferred to the SPUG (small power utilities group). This will be the next step. The national government wold provide funds,” Aquino said.
The generators will augment demand for power in Mindanao at least until 2015 when new power plants are expected to start their operations.
Aquino stressed the need to first fine-tune the mechanism before purchasing the generators since under the Electric Power Industry Reform Act, the government is prohibited to buy additional generating capacity.
“There is a provision on the Epira Law prohibiting to purchase the Napocor (National Power Corp.). That is being studied. But what is the mechanism? Who is authorized to purchase to ease up the power shortage? There is the funds,” Aquino said.
Aquino said the mechanism should fall within the purview of the law. He said he wants to make sure that government actions complies with the law.
Aquino told the local leaders that the government provides a subsidy for Palawan and Mindoro areas where SPUG services are needed.
“Now, those were subsidized. But in Mindoro when their wind and hydro and a geothermal that is being looked into, they would be detached from the SPUG. Maybe they can be independent already, even they can have surplus to export. Between Mindoro and Palawan, when they detached from the SPUG, 50 percent of their expenses on missionary roots is also removed,” Aquino said.
Aquino also expressed concern over the proposal to rely solely on the SPUG for power supply.
“This SPUG is also a problem there, besides, the generating sets are too old. It is as if in the maintenance alone there is losses,” Aquino said.
Aquino also wooed hundreds of residents in Buluan, Maguindanao province, Autonomous Region in Muslim Mindanao to vote for the administration candidates with promises of reforms in the election fraud ridden areas.
“In the righteous path, we have proven the possibility to have a kind of government that cares and honest, where there is possible equality and good opportunity, whether in Luzon, Visayas, or in Mindanao,” Aquino said.

  1. Did you miss the 'administration' in your article?
  2. Do you really think that Cory Aquino's administration failed to plan ahead that time? Or was the power crisis planned ahead that time to further enrich those in power?
  3. Is it possible that today's power crisis was also planned ahead for the same reason as in #2?
  4. Were not the Lopezes of Meralco and the Aboitizes close friends of the Aquinos since the time of the dictator?

Ninoy vowed to drop Sabah claim to get KL support vs Marcos’

MANILA, Philippines - Former senator Benigno “Ninoy” Aquino Jr. had promised Malaysia in 1983 that the Philippines would drop its claim over Sabah in exchange for its support in the move to oust strongman Ferdinand Marcos, a former foreign affairs official revealed yesterday.
Hermes Dorado, former national territory division head of the Department of Foreign Affairs, said Aquino met with then Malaysian Prime Minister Mohammad Mahathir before he went back to the Philippines and was assassinated on Aug. 21, 1983.
Dorado said there were no official records of the supposed meeting between Aquino and Mahathir, but said he “became privy to this bit of intelligence” from former ambassador and retired general Rafael Ileto.
“General Ileto indirectly confirmed that Ninoy Aquino asked for help from Mahathir in exchange for dropping the Sabah claim when he gains power,” Dorado told a forum at the University of the Philippines in Quezon City.
Dorado said Ileto was the person assigned to monitor Aquino’s movement on his journey back to Manila.
“There was a commitment to help oust Marcos,” he added. “That is the reason why the government today is somehow reluctant to support the Sabah claim.”

“Our hands are tied today because the leadership up to this day is committed to drop the Philippine claim of Sabah,” he said.
According to Dorado, the clearest proof of Ninoy’s supposed pledge to Malaysia will be found in the 1987 Constitution, which was written during the presidency of his widow Corazon Aquino.
Dorado said the 1987 Constitution amended the first article of the 1973 Constitution and removed the phrase, “and all other territories belonging to the Philippines by historic right or legal title.”
The 1987 Constitution revised the definition of Philippine territory and “deleted Sabah as a historic claim backed up by the legal title pertaining to the sultanate of Sulu,” he added.
Dorado said Mrs. Aquino had no choice but to honor Ninoy’s commitment to Mahathir because she needed support from ASEAN nations to legitimize her ascendancy to the presidency through the people power revolution.
“Malaysian Prime Minister Mahathir adamantly refused to attend the ASEAN Summit in Manila until President Cory made a firm commitment to amend Article 1 of the 1973 Constitution,” Dorado pointed out.
“Malaysian hard-ball diplomatic and guerrilla war maneuverings, backed by shrewd use of economic leverage, sourced from huge revenues from oil extracted in Sabah, were completed by 1987,” he added.
“They succeeded in forcing the Constitutional Commission to drop the Philippine Sabah claim, hands down.”
Dorado said the amended Baselines Law approved in March 2009 resulted in the exclusion of Sabah from the Philippine territory.
He said the amended law removed Section 2 of the 1968 law that included the phrase, “…the territory of Sabah, situated in North Borneo, over which the Republic of the Philippines has acquired dominion and sovereignty.”
“Removal of the specific reference to Sabah represented a disastrous outcome to the claims of the sultanate of Sulu,” Dorado said.
He claimed the results of the supposed “Ninoy-Mahathir pact” have destroyed all peaceful possibilities of pursuing the country’s claims.

Proprietary rights

Reacting to Dorado’s presentation, Princess Jacel Kiram – daughter of Sulu Sultan Jamalul Kiram III – maintained that Filipinos have proprietary rights in Sabah.
“We have so much wealth in Sabah na dapat tayo ang nakikinabang (we should be the ones benefitting),” Jacel said.
She said the lease agreement over North Borneo expired in 1978.
She accused the Aquino administration of protecting the interests of the Malaysian prime minister rather than the interest of the Filipino people.
“I would prefer to be another (nationality) rather than a Filipino citizen under our current set of leaders,” she said.
During the forum, Jacel confirmed the meeting between her uncle Sultan Bantilan Esmail Kiram II and Interior Secretary Manuel Roxas II.
“This is the first official talk from our side and from the side of the government,” she said, declining to provide additional information as she was not privy to what was discussed in the meeting.
Jacel said the development was a “good gesture” on the part of the government, and that its intention was for the benefit of the Filipino people.

TITLE OF ACT

Section 1. This Act shall be known as “The Philippine Immigration Act of 1940.”

BUREAU OF IMMIGRATION

Section 2. Officials. – A Bureau of Immigration is established under a Commissioner of Immigration, who shall have two assistants, a First Deputy Commissioner of Immigration and a Second Deputy Commissioner of Immigration. For administrative purposes, the Bureau of Immigration shall be under the supervision and control of the Department of Labor or of any other executive department which the President may subsequently determine.

COMMISSIONER OF IMMIGRATION

Section 3. Appointment; term of office; compensation. – The Commissioner of Immigration shall be appointed by the President, with the consent of the Commission on Appointments of the National Assembly, and shall hold office at the pleasure of the President. He shall receive compensation at the rate of ten thousand pesos per annum. Administrative head powers as such – He shall be the administrative head of the Bureau of Immigration and shall possess the powers generally conferred upon bureau chiefs. He shall have charge of the administration of all laws relating to the immigration of aliens into the Philippines and shall have the immediate control, direction and supervision of all officers, clerks, and employees of the Bureau of Immigration. He shall issue, subject to the approval of the Department Head, such rules and regulations and prescribe such forms of bond, reports, and other papers, and shall issue from time to time such instructions, not inconsistent with law, as he shall deem best calculated to carry out the provisions of the immigration laws. He shall submit a report to the President, in writing, of the transactions of his office, annually or oftener as the President may require.

DEPUTY COMMISSIONERS OF IMMIGRATION

Section 4. (a) Appointment; term of office; compensation. – The two Deputy Commissioners 9 shall be appointed by the President, with the consent of the Commission on Appointments of the National Assembly, 10 and they shall hold office at the pleasure of the President. The First Deputy Commissioner 11 shall receive compensation at the rate of nine thousand pesos per annum and the Second Deputy Commissioner shall receive compensation at the rate of eight thousand four hundred pesos 13 per annum. During the absence or disability of the Commissioner, the First Deputy Commissioner 14 shall act as Commissioner, and during the absence or disability of both the Commissioner and the First Deputy Commissioner, 15 the Second Deputy Commissioner 16 shall act as Commissioner, and the Deputy Commissioner 17 who shall so act as Commissioner shall perform the duties of the latter in addition to his own duties.
(b) No person shall be appointed Commissioner or Deputy Commissioner 18 unless he be a natural-born citizen of the Philippines and is at least thirty years of age.

IMMIGRANT INSPECTORS 19

Section 5. (a) The position of Immigrant Inspector 20 is created, appointments to which shall be made upon the recommendation of the Commissioner of Immigration in accordance with the Civil Service Laws. 21

(b) Whenever he shall deem it necessary, the Commissioner of Immigration may appoint, with the consent of the proper Department Head, any qualified employee of the Government to serve as Acting Immigrant Inspector 22 Acting Immigrant Inspectors 23 shall have the same powers and authority as Immigrant Inspectors. 24

Section 6. Powers of Immigration Officer. – The examination of aliens concerning their right to enter or remain in the Philippines shall be performed by Immigrant Inspectors 25 with the advice of medical authorities in appropriate cases. Immigrant Inspectors 26 are authorized to exclude any alien not properly documented as required by this Act, admit any alien complying with the applicable provisions of the immigration laws and to enforce the immigration laws and regulations prescribed thereunder. Immigrant Inspectors 27 are also empowered to administer oaths, to take and consider evidence concerning the right of any alien to enter or reside in the Philippines, and to go aboard and search for aliens on any vessel or other conveyance in which they believe aliens are being brought into the Philippines. Immigrant Inspectors 28 shall have the power to arrest, without warrant, any alien who in their presence or view is entering or is still in the course of entering the Philippines in violation of immigration laws or regulations prescribed thereunder. 29

OTHER EMPLOYEES

Section 7. Appointment and Salary. – All other employees of the Bureau of Immigration 30 except as otherwise provided in this Act shall be appointed by the Head of Department, upon the recommendation of the Commissioner of Immigration, in accordance with civil service rules and regulations, and they shall receive such salaries as may be assigned to them conformably to the provisions of Commonwealth Act Numbered Four hundred and two. 31

ASSIGNMENT OF IMMIGRATION EMPLOYEES TO OVERTIME. WORK

Section 7-A. Immigration employees may be assigned by the Commissioner of Immigration to do overtime work at rates fixed by him when the service rendered is to be paid for by shipping companies and airlines or other persons served. 32
