THE former national security adviser of the late President Cory Aquino called for the removal of oligarchs in government Thursday night, saying only this would improve the lives of the majority of poor Filipinos.
Speaking at an assembly calling for the establishment of a “National Transformation Council,”Jose Almonte said oligarchs were the main reason the poor continue to be deprived and the political system remains unstable.
An oligarchy describes a government by a few, especially by a small faction of persons or families.
Almonte said most of the oligarchs were in Malacañang and should be removed, so that the government could serve the common good rather than the interests of a few.
He said because the oligarchs controlled national policies in both their formation and implementation stages, it is their interests that are served.
Asked how the oligarchs could be removed, Almonte said this could be done by election reform, where the process is not defined by those who control the resources.
Almonte said he supported the establishment of a “National Transformation Council,” being pushed by church leaders, academicians, politicians, and professionals aimed at overhauling the country’s political system.
The council has been linked to the “Bayan Ko” group, which supports immediate and drastic reform in the wake of the corruption surrounding the pork barrel scam and the Disbursement Acceleration Program.
“In order to overcome our problems, let us end our internal war,” Almonte said. “The power to formulate policies that are in the hands of the few must be transferred to the people.”
On the other hand, Bishop Ramon Arguelles said corrupt officials, particularly those involved in PDAF and DAP and other anomalies, should repent as he urged Filipinos to unite for the transformation.
“The 2016 election does not give any promise of a better future for our country. We have to move for total change of our systems,” Arguelles said.

“We should change the mentally of people and little people must have a greater voice in national issues,” he added.
In the assembly, Carmen Pedrosa, a former director of the Ninoy Aquino Movement, blasted President Benigno Aquino III for the massive corruption taking place under his administration.
“How can we not be angry? They have stolen our money without doing their jobs. When will things change?” she said.
Among the council’s priorities is the drafting of a new constitution.
Also present during the launching of the NTC were former Arned Forces chief of staff, Hermogenes Esperon, former Defense chief Norberto Gonzalez, former senator Francisco Tatad, Bishop Fernando Capalla, President Aquino’s aunt, Margarita Cojuangco,Pastor Art Corpuz of the United Church of Christ of the Philippines, Volunteers Against Crime and Corruption chairman Dante Jeminez, Rep. Glenn Chong, and Carmen Kilayco, chairperson of Tanggulan ng Demokrasya.

Ninoy vowed to drop Sabah claim to get KL support vs Marcos’

MANILA, Philippines - Former senator Benigno “Ninoy” Aquino Jr. had promised Malaysia in 1983 that the Philippines would drop its claim over Sabah in exchange for its support in the move to oust strongman Ferdinand Marcos, a former foreign affairs official revealed yesterday.
Hermes Dorado, former national territory division head of the Department of Foreign Affairs, said Aquino met with then Malaysian Prime Minister Mohammad Mahathir before he went back to the Philippines and was assassinated on Aug. 21, 1983.
Dorado said there were no official records of the supposed meeting between Aquino and Mahathir, but said he “became privy to this bit of intelligence” from former ambassador and retired general Rafael Ileto.
“General Ileto indirectly confirmed that Ninoy Aquino asked for help from Mahathir in exchange for dropping the Sabah claim when he gains power,” Dorado told a forum at the University of the Philippines in Quezon City.
Dorado said Ileto was the person assigned to monitor Aquino’s movement on his journey back to Manila.
“There was a commitment to help oust Marcos,” he added. “That is the reason why the government today is somehow reluctant to support the Sabah claim.”

“Our hands are tied today because the leadership up to this day is committed to drop the Philippine claim of Sabah,” he said.
According to Dorado, the clearest proof of Ninoy’s supposed pledge to Malaysia will be found in the 1987 Constitution, which was written during the presidency of his widow Corazon Aquino.
Dorado said the 1987 Constitution amended the first article of the 1973 Constitution and removed the phrase, “and all other territories belonging to the Philippines by historic right or legal title.”
The 1987 Constitution revised the definition of Philippine territory and “deleted Sabah as a historic claim backed up by the legal title pertaining to the sultanate of Sulu,” he added.
Dorado said Mrs. Aquino had no choice but to honor Ninoy’s commitment to Mahathir because she needed support from ASEAN nations to legitimize her ascendancy to the presidency through the people power revolution.
“Malaysian Prime Minister Mahathir adamantly refused to attend the ASEAN Summit in Manila until President Cory made a firm commitment to amend Article 1 of the 1973 Constitution,” Dorado pointed out.
“Malaysian hard-ball diplomatic and guerrilla war maneuverings, backed by shrewd use of economic leverage, sourced from huge revenues from oil extracted in Sabah, were completed by 1987,” he added.
“They succeeded in forcing the Constitutional Commission to drop the Philippine Sabah claim, hands down.”
Dorado said the amended Baselines Law approved in March 2009 resulted in the exclusion of Sabah from the Philippine territory.
He said the amended law removed Section 2 of the 1968 law that included the phrase, “…the territory of Sabah, situated in North Borneo, over which the Republic of the Philippines has acquired dominion and sovereignty.”
“Removal of the specific reference to Sabah represented a disastrous outcome to the claims of the sultanate of Sulu,” Dorado said.
He claimed the results of the supposed “Ninoy-Mahathir pact” have destroyed all peaceful possibilities of pursuing the country’s claims.

Proprietary rights

Reacting to Dorado’s presentation, Princess Jacel Kiram – daughter of Sulu Sultan Jamalul Kiram III – maintained that Filipinos have proprietary rights in Sabah.
“We have so much wealth in Sabah na dapat tayo ang nakikinabang (we should be the ones benefitting),” Jacel said.
She said the lease agreement over North Borneo expired in 1978.
She accused the Aquino administration of protecting the interests of the Malaysian prime minister rather than the interest of the Filipino people.
“I would prefer to be another (nationality) rather than a Filipino citizen under our current set of leaders,” she said.
During the forum, Jacel confirmed the meeting between her uncle Sultan Bantilan Esmail Kiram II and Interior Secretary Manuel Roxas II.
“This is the first official talk from our side and from the side of the government,” she said, declining to provide additional information as she was not privy to what was discussed in the meeting.
Jacel said the development was a “good gesture” on the part of the government, and that its intention was for the benefit of the Filipino people.

COMMONWEALTH ACT NO. 613
AN ACT TO CONTROL AND REGULATE THE IMMIGRATION OF ALIENS INTO THE PHILIPPINES

TITLE OF ACT

Section 1. This Act shall be known as “The Philippine Immigration Act of 1940.”

BUREAU OF IMMIGRATION

Section 2. Officials. – A Bureau of Immigration is established under a Commissioner of Immigration, who shall have two assistants, a First Deputy Commissioner of Immigration and a Second Deputy Commissioner of Immigration. For administrative purposes, the Bureau of Immigration shall be under the supervision and control of the Department of Labor or of any other executive department which the President may subsequently determine.

COMMISSIONER OF IMMIGRATION

Section 3. Appointment; term of office; compensation. – The Commissioner of Immigration shall be appointed by the President, with the consent of the Commission on Appointments of the National Assembly, and shall hold office at the pleasure of the President. He shall receive compensation at the rate of ten thousand pesos per annum. Administrative head powers as such – He shall be the administrative head of the Bureau of Immigration and shall possess the powers generally conferred upon bureau chiefs. He shall have charge of the administration of all laws relating to the immigration of aliens into the Philippines and shall have the immediate control, direction and supervision of all officers, clerks, and employees of the Bureau of Immigration. He shall issue, subject to the approval of the Department Head, such rules and regulations and prescribe such forms of bond, reports, and other papers, and shall issue from time to time such instructions, not inconsistent with law, as he shall deem best calculated to carry out the provisions of the immigration laws. He shall submit a report to the President, in writing, of the transactions of his office, annually or oftener as the President may require.

DEPUTY COMMISSIONERS OF IMMIGRATION

Section 4. (a) Appointment; term of office; compensation. – The two Deputy Commissioners 9 shall be appointed by the President, with the consent of the Commission on Appointments of the National Assembly, 10 and they shall hold office at the pleasure of the President. The First Deputy Commissioner 11 shall receive compensation at the rate of nine thousand pesos per annum and the Second Deputy Commissioner shall receive compensation at the rate of eight thousand four hundred pesos 13 per annum. During the absence or disability of the Commissioner, the First Deputy Commissioner 14 shall act as Commissioner, and during the absence or disability of both the Commissioner and the First Deputy Commissioner, 15 the Second Deputy Commissioner 16 shall act as Commissioner, and the Deputy Commissioner 17 who shall so act as Commissioner shall perform the duties of the latter in addition to his own duties.
(b) No person shall be appointed Commissioner or Deputy Commissioner 18 unless he be a natural-born citizen of the Philippines and is at least thirty years of age.

IMMIGRANT INSPECTORS 19

Section 5. (a) The position of Immigrant Inspector 20 is created, appointments to which shall be made upon the recommendation of the Commissioner of Immigration in accordance with the Civil Service Laws. 21

(b) Whenever he shall deem it necessary, the Commissioner of Immigration may appoint, with the consent of the proper Department Head, any qualified employee of the Government to serve as Acting Immigrant Inspector 22 Acting Immigrant Inspectors 23 shall have the same powers and authority as Immigrant Inspectors. 24

Section 6. Powers of Immigration Officer. – The examination of aliens concerning their right to enter or remain in the Philippines shall be performed by Immigrant Inspectors 25 with the advice of medical authorities in appropriate cases. Immigrant Inspectors 26 are authorized to exclude any alien not properly documented as required by this Act, admit any alien complying with the applicable provisions of the immigration laws and to enforce the immigration laws and regulations prescribed thereunder. Immigrant Inspectors 27 are also empowered to administer oaths, to take and consider evidence concerning the right of any alien to enter or reside in the Philippines, and to go aboard and search for aliens on any vessel or other conveyance in which they believe aliens are being brought into the Philippines. Immigrant Inspectors 28 shall have the power to arrest, without warrant, any alien who in their presence or view is entering or is still in the course of entering the Philippines in violation of immigration laws or regulations prescribed thereunder. 29

OTHER EMPLOYEES

Section 7. Appointment and Salary. – All other employees of the Bureau of Immigration 30 except as otherwise provided in this Act shall be appointed by the Head of Department, upon the recommendation of the Commissioner of Immigration, in accordance with civil service rules and regulations, and they shall receive such salaries as may be assigned to them conformably to the provisions of Commonwealth Act Numbered Four hundred and two. 31

ASSIGNMENT OF IMMIGRATION EMPLOYEES TO OVERTIME. WORK

Section 7-A. Immigration employees may be assigned by the Commissioner of Immigration to do overtime work at rates fixed by him when the service rendered is to be paid for by shipping companies and airlines or other persons served. 32
